1. Decree No. 69/2010/ND-CP (Biosafety Decree)

This foundational decree, effective from August 10, 2010, outlines the biosafety requirements for GMOs, genetic specimens, and their products. Key provisions include:

Risk Assessment: Mandates scientific and transparent risk assessments for GMOs, considering potential impacts on the environment, biodiversity, and human and animal health.

Biosafety Certificates: Establishes procedures for granting biosafety certificates, requiring satisfactory assay results and approval from the Biosafety Council.

Risk Management: Obligates organizations and individuals involved with GMOs to implement risk management measures and report incidents promptly.

Inspection and Enforcement: Empowers relevant authorities to conduct inspections and enforce compliance, with penalties for violations.

This decree has been amended several times to enhance its provisions and align with evolving scientific and regulatory standards.

2. Decree No. 118/2020/ND-CP

Amending Decree No. 69/2010/ND-CP, this decree, effective from October 2, 2020, introduces:(Dulieu Phap Luat)

Recognition of Testing Results: Specifies timelines and procedures for recognizing GMO testing results, enhancing efficiency in the approval process.

Public Consultation: Requires public disclosure of risk assessment reports for public comment before granting biosafety certificates

3. Circular No. 21/2012/TT-BKHCN

Issued by the Ministry of Science and Technology, this circular governs biosafety in GMO research and development. It applies to both domestic and foreign entities and outlines:

Research Guidelines: Defines GMO research activities and associated risks)

Biosafety Management: Establishes requirements for biosafety measures in research settings.
