Competition and Consumer Protection Act 2014 (CCPA 2014)

The CCPA 2014 consolidated and updated previous legislation, focusing on:

Prohibiting Anti-Competitive Agreements: Such as price-fixing, market sharing, and bid-rigging.

Preventing Abuse of Dominant Position: By firms with substantial market power.

Merger Control: Assessing and regulating mergers and acquisitions that may substantially lessen competition.

Consumer Protection: Ensuring fair trading and protecting consumer rights.

Competition (Amendment) Act 2022

This Act, effective from 27 September 2023, introduced significant reforms:

Administrative Fines: The CCPC can now impose civil fines up to €10 million or 10% of a company's worldwide turnover, whichever is greater, for breaches of competition law.

Enhanced Criminal Penalties: Increased fines up to €50 million or 20% of turnover for serious offences. 

Improved Enforcement Tools: Including surveillance powers and the ability to 'call in' below-threshold mergers that may affect competition. 

Whistleblower Protections: Encouraging reporting of anti-competitive practices.

The CCPC enforces competition law through:

Investigations: Into anti-competitive practices and consumer protection issues.

Prosecutions: In cases of serious breaches, including cartel activities.

Civil Penalties: Imposed directly by the CCPC for certain infringements.

Court Orders: Seeking injunctions or declarations to stop anti-competitive conduct.
