Concept of Property

The right to transfer or dispose of it (sell, gift, lease, etc.).

Types of Property

Property can be broadly classified into two major types:

1. Movable Property (Personal Property)

Definition: Property that can be physically moved from one place to another.

Examples: Vehicles, furniture, jewelry, money, stocks, animals, etc.

Characteristics:

Can be transferred easily.

Includes tangible and intangible assets.

2. Immovable Property (Real Property)

Definition: Property that cannot be moved from one place to another.

Examples: Land, buildings, houses, trees attached to the land.

Characteristics:

Usually requires registration to prove ownership.

Transfer involves formal processes.

Other Classifications of Property:

a) Tangible vs. Intangible Property

Tangible: Physical objects (car, book, house).

Intangible: Non-physical assets (stocks, patents, copyrights).

b) Private vs. Public Property

Private Property: Owned by individuals or corporations (your car, your home).

Public Property: Owned by the government or community (parks, roads).

c) Legal vs. Equitable Property

Legal Property: Ownership recognized by law.

Equitable Property: Rights recognized in equity (like a beneficiary’s interest under a trust).
