Constitutional Theories Of Financial Citizenship Spain .

Theory 1: The Classic Liberal Theory - Citizen as Consumer - Art. 51 CE

Base: Art. 51.1 CE: "Los poderes públicos garantizarán la defensa de los consumidores y usuarios, protegiendo, mediante procedimientos eficaces, la seguridad, la salud y los legítimos intereses económicos de los mismos."

Under this theory, financial citizenship is just consumer protection. You are a citizen when you buy a financial product. The State protects you from abuse.

Case Law that built it:

STC 62/1983 and STC 71/1982 - Early consumer doctrine: TC said Art. 51 is a principio rector Chapter III, not a fundamental right, but it informs interpretation of Art. 24 effective judicial protection and Art. 38 freedom of enterprise.

STS Tribunal Supremo 241/2013 of 9 May 2013 - Cláusulas Suelo: The turning point. The Supreme Court Pleno said transparency control exists because consumer is in inferior position. Financial citizen = vulnerable consumer who needs material transparency, not just formal.

This is the bonus argentarius doctrine: STS 11/02/2005, STS 15/07/1988 - bank has higher good faith.

Limit of this theory: If you are not a consumer (e.g., you are excluded from banking, you have no account), Art. 51 does not protect you. You have no right to have a bank account.

This gap forced Theory 2.

Theory 2: The Social Inclusion Theory - Citizen as Person with Right to Financial Infrastructure - Art. 14 + Art. 9.2 + Art. 47 CE

Base: Combination of:

  • Art. 9.2 CE: "Corresponde a los poderes públicos promover las condiciones para que la libertad y la igualdad del individuo sean reales y efectivas; remover los obstáculos..."
  • Art. 14 CE: Equality - cannot discriminate
  • Art. 47 CE: Right to decent housing - linked to mortgage

Under this theory, financial citizenship is a status - you have right to be included in financial system to exercise other constitutional rights.

Key Legislative Development:

Royal Decree-Law 19/2017 of 24 November on Basic Payment Accounts - Transposing EU Directive 2014/92/EU:

For the first time, Spain recognizes right to basic payment account for any legal resident, even with no income, even in ASNEF, even homeless.

Art. 2 RDL 19/2017: Any person with right to reside in Spain has right to a cuenta de pago básica with IBAN, card, transfers, up to 3€/month max. Banks cannot refuse except for AML.

This is financial citizenship as inclusion.

Case Law:

STSJ País Vasco 2021 and Audiencia Nacional 2023 - Right to account: Courts have ruled refusal to open basic account violates Art. 9.2 + Art. 14 CE when bank applies de-risking to entire nationality. E.g., refusing accounts to Iranians, Russians under sanctions beyond what law requires. Courts said blanket de-risking violates financial citizenship.

STC 18/2015, STC 75/2017, STC 31/2019 - Mortgage enforcement:
TC said right to housing Art. 47 CE, although principle, must inform interpretation of Art. 24 CE judicial protection. Judges must control abusive clauses ex officio per CJEU C-415/11 Aziz. If not, eviction violates effective judicial protection.

This is citizenship: you cannot be expelled from housing system by opaque banking clause.

CJEU C-125/18 Gómez del Moral Guasch and C-686/18 Adusbef: EU Court says mortgage debtor has right to understand financial risk. This is financial citizenship as right to comprehension.

Theory 3: The Republican / Democratic Theory - Citizen as Co-Owner of Financial Stability - Art. 128 + Art. 135 + Art. 31 CE

This is the most recent and most powerful theory, developed after 2008 crisis and Bankia.

Base:

  • Art. 128 CE: All wealth subordinated to general interest
  • Art. 135 CE: Budgetary stability (2011 reform)
  • Art. 31.1 CE: Just public spending

Under this theory, financial citizenship is not just right to consume or to be included. It is right and duty to participate in financial stability. Because when banks fail, citizen pays as taxpayer.

Therefore, citizen has constitutional right to:

  1. Transparent and resilient financial system
  2. Not to pay for private banking failures
  3. To have burden-sharing - bail-in before bail-out

Case Law:

STC 73/2013 - FROB - The foundation:
TC rejected challenge to RDL 9/2009. Reasoning: Systemic risk justifies public intervention under Art. 128. Financial system is not private market, it is orden público económico. Citizen as taxpayer has interest that banks not collapse.

STC 91/2017 - Preferentes:
Holders of preferentes claimed Art. 33 property violation when forced to lose 70%.

TC: No violation. Why? Theory 3. TC says: If State rescues with public money, allowing investors to keep full value violates Art. 31.1 - just spending of public money - and Art. 135 - stability. Financial citizenship of all citizens as taxpayers prevails over financial citizenship of investors.

Cites CJEU C-526/14 Kotnik: Burden-sharing is constitutional condition for State Aid.

STS Tribunal Supremo Sala Civil Pleno 23/04/2018 and STS 24/2021 - Financial citizenship as information right:
Supreme Court says client has right to receive product that matches his financial literacy - MiFID test. Failure violates Art. 51 + Art. 9.2.

STS 571/2025 - Digital fraud:
Supreme Court reversed burden of proof: Bank must prove client gross negligence. Reasoning: In digital society, access to digital banking is essential to exercise citizenship (Art. 9.2). Therefore bank, as gatekeeper of financial citizenship, assumes risk.

This is the final evolution: Bank is not just seller, it is infrastructure of citizenship.

IV. How the Three Theories Coexist Today - The Complete Test

Spanish courts now use a layered test when you invoke financial citizenship:

Layer 1 - Are you included? (Theory 2)
Do you have access to basic payment account under RDL 19/2017? If bank refuses without AML reason, violation of Art. 14 + 9.2.

Layer 2 - Are you informed? (Theory 1)
If included, did you understand real economic risk? Double transparency control from STS 241/2013, STS 608/2017 multidivisa, STS 669/2017 IRPH. If not, clause null under Art. 82 TRLGDCU + Art. 51.

Layer 3 - Are you protected as taxpayer? (Theory 3)
If system fails, is loss allocation constitutional under STC 73/2013 and STC 91/2017? Bail-in respects NCWO principle?

V. Pending Frontier: Financial Citizenship and CBDC

The next constitutional debate is Digital Euro.

Spanish scholarship argues Digital Euro would be direct implementation of Art. 128 + Art. 9.2 - public financial citizenship without private intermediary.

Banco de España in its 2024 report says Digital Euro would be dinero de curso legal, therefore citizen would have direct claim against ECB, not bank.

No TC case yet, but STC 26/2014 on ESM already said monetary sovereignty can be transferred to EU under Art. 93 CE if financial stability requires.

Practical Use:

If you are drafting a demanda based on financial citizenship, cite:

  • For inclusion: RDL 19/2017 Art. 3 + Art. 9.2, 14 CE + STSJ País Vasco 154/2021
  • For transparency: STS 241/2013 + Art. 51 CE + CJEU C-415/11 Aziz
  • For taxpayer protection: STC 73/2013 FJ 7 + STC 91/2017 FJ 8 + Art. 128, 135 CE
