Section 157: Information of cognizable case to be given, immediately on receipt, to an officer in charge of a police station

Text:

"Whenever information is given, orally or in writing, of the commission of a cognizable offence, the officer in charge of the police station shall, if such information is given orally, reduce the same to writing, and register the information as a First Information Report (FIR), and immediately proceed to the investigation of the offence or cause the same to be investigated by any police officer subordinate to him."

Explanation:

When the police receive information about a cognizable offence (i.e., an offence where police can investigate without magistrate’s permission), they must:

Record the information in writing if given orally.

Register the information as a First Information Report (FIR).

Immediately start investigation or assign a subordinate officer to do so.

This section ensures that police cannot ignore or delay taking action on cognizable offences.

Purpose:

To provide a formal starting point for police investigation.

To safeguard the rights of victims by ensuring prompt action.

To establish official documentation of complaints for transparency.

Example:

If a person reports a robbery at their home to the police station, the officer must record the complaint in writing, register an FIR, and begin investigating immediately as per Section 157.
