Section 279 IPC: Rash Driving or Riding on a Public Way

Text of Section 279 IPC:

"Whoever drives any vehicle, or rides, on any public way in a manner so rash or negligent as to endanger human life, or to be likely to cause hurt or injury to any other person, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both."

Whoever drives or rides:

Driving a car at very high speed in a crowded market street.

Riding a motorcycle without control, zigzagging among pedestrians.

Ignoring traffic signals and driving through a red light recklessly.

Performing stunts or reckless maneuvers on a public road.

Punishment:

Imprisonment: Up to 6 months (could be simple or rigorous imprisonment).

Fine: Up to ₹1,000.

Or both: The court may impose imprisonment, or fine, or both.

Important Points:

The section focuses on danger caused due to rashness or negligence, not necessarily requiring actual injury.

The act must be on a public way; rash driving in private premises might not attract this section.

If actual injury or death occurs due to rash or negligent driving, more serious offenses under other sections (like Sections 304A or 337 IPC) may apply.

Difference from Section 304A IPC:

Section 279 IPC punishes rash or negligent driving endangering life or likely to cause injury.

Section 304A IPC deals with causing death by rash or negligent act, which is more serious and involves actual death.
