CrPC Section 356
Section 356 of the Criminal Procedure Code (CrPC), 1973 (India):
Section 356 - Police to give information of commission of certain offences
Text:
Whenever the police receive information that any person has committed the following offenses:
Murder (Section 302 IPC),
Attempt to commit murder (Section 307 IPC),
Rape (Section 376 IPC),
Culpable homicide not amounting to murder (Section 304 IPC),
Dacoity (Section 395 IPC),
Robbery (Section 392 IPC),
Theft (Section 379 IPC),
Or any other offense punishable with imprisonment for life or imprisonment for a term exceeding two years,
the police officer in charge of the police station shall immediately send a report of the information to the Magistrate having jurisdiction to take cognizance of such offense.
Explanation:
This section mandates that the police must inform the magistrate immediately upon receiving information about the commission of serious offenses.
The offenses mentioned are serious in nature, typically warranting formal investigation and judicial scrutiny.
This helps ensure prompt judicial oversight and action from the beginning of the investigation.
The report sent to the magistrate is commonly known as a First Information Report (FIR).
This section essentially ensures the magistrate is aware and can exercise jurisdiction to take cognizance of the offense.
Purpose:
To ensure quick involvement of the judicial magistrate in serious cases.
To prevent police delay or neglect in registering or investigating serious crimes.
To promote transparency and accountability in law enforcement.
