Text of Section 523 CrPC:

When a person is committed to a Court of Session for trial, the Magistrate shall forward to the Court of Session the committal papers and other documents relating to the case, together with the accused, if in custody, or a warrant for his arrest if he is not in custody.

Explanation:

When a Magistrate sends an accused to a Sessions Court for trial (usually for serious offences),

The Magistrate must send all case documents (committal papers, evidence, etc.) along with the accused.

If the accused is not in custody, the Magistrate issues a warrant to ensure the accused is brought before the Sessions Court.

Purpose:

To ensure a smooth and proper transfer of the case from the Magistrate to the Sessions Court.

To provide the Sessions Court with all necessary documents and the accused for trial.

This section is part of the procedure for trial of serious offences that go beyond the jurisdiction of Magistrates.
