CrPC Section 67

Section 67 of the Code of Criminal Procedure (CrPC), India

Section 67: Summons how served

Text:

"Every summons shall be served by a police officer, or subject to such rules as the State Government may make in this behalf, by an officer of the Court issuing it or other public servant; and it shall if practicable be served personally on the person summoned, by delivering or tendering to him one of the duplicates of the summons."

Explanation:

Section 67 lays down the procedure for serving summons in criminal cases.

✅ Key Points:

Who Can Serve the Summons?

A police officer

An officer of the court

Any other public servant authorized by the State Government

Mode of Service:

Personal service is preferred, meaning the summons should be personally handed over to the person summoned, if practicable.

A duplicate copy of the summons must be delivered or tendered.

Purpose:

This ensures that the person receives official notice to appear before a court, and the process follows a clear, regulated procedure.

Example:

If the court issues a summons to a person accused of theft, a police officer may personally visit the accused and hand them a duplicate of the summons, asking them to appear in court on a specified date.
