CrPC Section 80
📖 Section 80 CrPC – Procedure on Arrest of Person against whom Warrant issued
This section lays down the procedure to be followed when a person is arrested under a warrant issued by a court.
🔹 Key Provisions of Section 80:
Arrest under Warrant:
When a police officer or any authorized person arrests someone under the authority of a warrant, they must bring the arrested person before the Court that issued the warrant.
Timeframe:
The arrested person must be presented without unnecessary delay.
The law is designed to prevent misuse of power and protect the rights of the arrested individual.
If the Arrest Takes Place Outside Jurisdiction:
If the person is arrested outside the local jurisdiction of the court which issued the warrant, then the procedure under Section 81 CrPC applies (production before the nearest Magistrate).
🔹 Purpose of Section 80:
To ensure that once a warrant is executed, the judicial authority remains in control of the case.
To safeguard personal liberty, so that the arrested person is not detained by the police unnecessarily or illegally.
📌 Example Scenario:
A Magistrate in Delhi issues a warrant against a person for committing fraud.
The police execute the warrant and arrest the person in Delhi itself.
Under Section 80, the police must produce the accused directly before the Delhi Magistrate who issued the warrant, without delay.
If the arrest had been made in another city (say Mumbai), then Section 81 would come into play, requiring production before a Mumbai Magistrate first.
✅ In summary:
Section 80 CrPC makes it mandatory that any person arrested under a warrant be brought before the court that issued the warrant, and that too without unnecessary delay. It protects the individual from unlawful detention and ensures judicial supervision.
