Cyber Law at Bangladesh

Bangladesh's cyber law landscape has undergone significant changes in recent years, with the enactment of the Cyber Security Act, 2023 (CSA), which replaced the previously controversial Digital Security Act, 2018 (DSA).

Cyber Security Act, 2023 (CSA)

The CSA was introduced in September 2023, aiming to address digital security concerns while responding to domestic and international criticism of the DSA. While the CSA retained many provisions from the DSA, it introduced some modifications. For example, the punishment for defamation under the CSA was adjusted to a fine of up to BDT 25 lakh, with imprisonment provisions removed for journalists. However, the CSA continued to include provisions that allowed for the detention of individuals without a warrant and imposed penalties for spreading propaganda against national symbols 

Repeal of the Cyber Security Act

In late 2024, the interim government of Bangladesh decided to repeal the CSA, acknowledging its controversial nature and the widespread criticism it received. The decision to repeal the CSA was made following discussions with various stakeholders, including legal experts and civil society organizations, who raised concerns about the law's impact on freedom of expression and human rights 

Current Status

As of now, the CSA has been repealed, and Bangladesh is in the process of reviewing and potentially drafting new legislation to address digital security concerns while safeguarding fundamental rights. The interim government has indicated its commitment to ensuring that any future laws in this domain will align with international human rights standards and promote transparency and accountability.
