Chad's primary legal instrument for combating cybercrime is Law No. 009/PR/2015, enacted on February 10, 2015, This law, integrated into the 2017 Criminal Code under Chapter 2, "Cybercrime," encompasses-
Unauthorized Access and System Interference: Penalties of 1–5 years imprisonment and fines ranging from 1 to 10 million CFA francs for fraudulent access to or interference with computer systems-
Data Breaches and Falsification:Severe penalties (5–10 years imprisonment and fines from 5 to 50 million CFA francs) for introducing, altering, or deleting data with fraudulent intent
Content-Related Offenses:Provisions addressing child pornography, online fraud, and the concealment of computer data
Cryptography and Spam:Regulations concerning the use of cryptographic tools and the dissemination of unsolicited electronic communications, Additionally, Law No. 14/PR/2015 on electronic communications includes criminal provisions related to the fraudulent use of public electronic communication networks and the intentional transmission of false or misleading signals
🔐 Data Protection
Enacted on February 10, 2015, Law No. 007/PR/2015 governs the collection, processing, and storage of personal data in Cha. It mandates that data controllers and processors operate transparently, ensure data accuracy, and uphold confidentialit. Violations can result in administrative penalties, including fines (ranging from 1 to 10 million CFA francs) and imprisonment (3 months to 1 year.
🏛️ Institutional Framewor
The National Agency for Computer Security and E-Certification (ANSICE), established by Law No. 006/PR/2015, is the central authority responsible for:
