Defamation By Bank Credit Reporting Dispute

1. When Credit Reporting Becomes Defamation?

Bank reports to 4 CICs: CIBIL (TransUnion), Experian, Equifax, CRIF High Mark. Reporting is mandatory under Sec 15 CIC Act.

Reporting becomes wrongful if:

  1. False Reporting: Reports defaulter when account settled / OTS done / no loan exists.
  2. No Notice Before Reporting: RBI Master Direction 2022 - bank must intimate customer before reporting as defaulter / SMA. Failure = deficiency.
  3. Failure to Update: After OTS / No Dues, bank must update CIBIL within 30 days. Continuing to show as defaulter = defamation per se.
  4. Identity Error: Reporting loan of Balaji Balram Singh against PAN of Balram Singh - wrong PAN mapping.
  5. Malicious Reporting: Reporting as defaulter to pressure recovery - vindictive attitude.

Legal Definition: Wrong entry in CIBIL that lowers credit score, causes loan rejection, causes loss of tender, lowers reputation - reputation is protected under Art 21 - Supreme Court in Subramanian Swamy vs UOI 2016 held right to reputation is integral to Art 21. Lowering CIBIL without basis infringes that.

2. Remedies - 4 Parallel Tracks

Track A - RBI Ombudsman / CIC Complaint
File dispute with CIBIL - CIBIL must forward to bank within 5 days, bank must correct within 30 days. If not, complaint to RBI Ombudsman under Grounds - Non-adherence to CIC directions - Compensation up to Rs.20 Lakhs.

Track B - Consumer Forum - Deficiency + Defamation
Bank is service provider, borrower is consumer (unless loan for profit generation). Wrong CIBIL reporting = deficiency in service.

Track C - Civil Suit for Defamation - Compensation
Claim Rs.3 Lakhs for mental agony + Rs.1 Lakh for defamation + loss of business - as filed in many cases.

Track D - Criminal Defamation - Sec 500 IPC / 356 BNS
If bank officials knowingly report false as defaulter to injure reputation.

3. Landmark Case Laws

A. Central Bank of India vs M/s Ad Bureau Advertising Pvt Ltd - Supreme Court - 2025 INSC 288 - 2 SCR 1445 - The Biggest

Facts: Ad Bureau took loan, later settled under OTS. Central Bank accepted OTS, issued No-Dues Certificate, filed full-satisfaction memo under RDDBFI Act before DRT, yet continued to report as defaulter to RBI/CIBIL. Company lost Airports Authority of India advertising tender worth crores because CIBIL showed defaulter.

NCDRC awarded Rs.75 Lakhs compensation + direction to issue certificate that loan settled + that reporting was wrong.

Bank appealed saying borrower not consumer because loan for commercial profit activity.

Supreme Court 2025 held:

  • Borrower not consumer if loan for profit generation with close nexus - so consumer complaint not maintainable against bank in this commercial case. NCDRC order set aside on technical ground of consumer definition.
  • BUT Court observed on merits: Wrong reporting after settlement is actionable and causes market loss. Court left open remedy via civil court.
  • Principle: After settlement, continuing to report as defaulter = wrongful, bank liable for business loss.

This is now used to argue in civil court, not consumer court, for commercial loans.

B. CIBIL Rating Challenged - Supreme Court - SBI & PNB - 2024 - Justice KV Viswanathan

Petitioner claimed CIBIL negative since 2020 despite no loan, no default. Supreme Court directed PNB and SBI to file affidavits stating whether any loan exists and whether default occurred. Shows SC entertains writ if CIBIL score destroyed without loan. Pending.

C. Surjeet Singh vs CIBIL Union Ltd - Consumer Court - 05.04.2024

Complainant had fictitious two-wheeler loan NPA shown. Filed complaint seeking deletion of fictitious loan + Rs.3 Lakhs for mental agony + Rs.1 Lakh for defamation. Court held CIBIL only maintains data given by banks, but bank must verify. Bank liable.

D. TransUnion CIBIL vs Deepak Kumar Khemka - Consumer Court - 2016
Court held:

"Case mainly directed against CIBIL report alleged to be wrong, false, derogatory and defamatory. Whether CIBIL report is derogatory and defamatory cannot be subject matter of consumer dispute if sanction of loan is bank's discretion."
But if report false, consumer dispute maintainable against bank, not CIBIL.

E. Karishma Raj vs SBI - Consumer / Civil
Claim for damages for defamation + Rs.1 Lakh for emotional pain for showing defaulter, taking 1 year to rectify after representations. Court: No malafide proved, but delay in rectifying after notice is deficiency - bank must credit and correct within 30 days.

F. Banks Cannot Be Criminally Liable for Declaring Account Fraudulent - HC - 2024
Company filed criminal defamation under Sec 500 r/w 34 IPC against senior officials of banks for declaring account fraudulent after forensic audit of Rs.250 Cr consortium loan. HC quashed - declaring account fraudulent after forensic audit is statutory duty under RBI Master Directions on Frauds 2016, not defamation. Protected under Sec 499 Exception 9 - good faith for protection of interest. To constitute defamation, must show malice, not bona fide regulatory action.

G. M. Venugopal Reddy vs TransUnion CIBIL - CCI / Privacy
Informant alleged CIBIL breached privacy by displaying PAN, Passport, Voter ID, Ration Card in report and posting fake data. He proposed to file cases under IPC for civil and criminal defamation. CIBIL defended as per CIC Act. Case shows privacy + defamation overlap.

4. How to Win Defamation by Credit Reporting Case

Evidence You Need:

  1. CIBIL report showing defaulter entry + date
  2. No-Dues / OTS letter / Loan closure letter
  3. Proof you intimated bank to correct and bank failed within 30 days (email, CIBIL dispute reference)
  4. Proof of loss - loan rejection letter citing CIBIL, tender rejection, email from bank saying "rejected due to CIBIL"
  5. CIBIL dispute trail - CIBIL dispute ID.

Draft Pleading Points:

  • Bank violated Sec 20 CIC Act - accuracy, Sec 21 - updating, RBI Master Direction 2022 Clause 7 - customer intimation before reporting.
  • Reporting false = defamation per se - lowers reputation in eyes of lenders - Sec 356 BNS.
  • Claim: Rectification + Rs.10-20 Lakhs for loss of reputation + business loss + litigation.

Defence Bank Takes (and how to counter):

  • "CIBIL only data repository" - Counter: Bank is source, under Sec 15 duty to ensure accuracy.
  • "Borrower not consumer" - Counter: Use civil court for commercial, consumer for individual housing/education loan - Supreme Court Ad Bureau case distinguishes.
  • "Fraud declaration protected" - Counter: Only if after forensic audit and due process under RBI Fraud Master Directions, not routine NPA reporting.
