Dormant Suspense Clearance .
PART A: DEFINITIONS AS PER RBI
1. Dormant / Inoperative Account [RBI Master Circular on Customer Service]
An account where there are no customer-induced transactions for a continuous period of 2 years is classified as Inoperative / Dormant.
Customer-induced = ATM withdrawal, UPI, cheque, RTGS, branch transaction. Bank-induced like interest credit, penalty debit does NOT count as operation.
Key RBI Rules effective Jan 2025 - June 2025 amendment:
- Banks must do annual review and inform customer 1 month before classifying as dormant via SMS, email, letter.
- No charges for inactivation.
- Reactivation is FREE. As per June 2025 amendment, reactivation can be done via:
a) Home branch with fresh KYC
b) Any branch - non-home branch
c) Video KYC [V-CIP] for low-risk customers
d) Through Business Correspondent - Operation must be allowed after due diligence, not automatically blocked if KYC is pending till June 30, 2026 for low-risk customers.
2. Suspense Account
A temporary general ledger account used when bank receives funds but does not know the final accounting head.
As per RBI definition: "It is used to ensure trial balance agrees when transaction advice is missing correct code."
Types in Core Banking:
- Sundry Suspense / Miscellaneous Suspense - Cash excess/short, ATM reconciliation, RTGS incoming without account number
- Interest Suspense - Interest on NPA/sticky advances not taken to P&L
- Inter-Branch Suspense - Funds in transit
RBI mandate: Suspense must be cleared by Back Office within T+1 day, maximum T+7 days. Long-standing balances in Suspense are treated as Serious Irregularity and potential fraud in RBI Statutory Audit - LFAR.
PART B: WHAT IS DORMANT SUSPENSE CLEARANCE?
It is the process of clearing two linked risks:
Scenario 1: Money parked in Suspense that actually belongs to a Dormant account.
Example: RTGS of Rs.5 lakh came with wrong account number, parked in Suspense. Original account is dormant since 2021. Clearance team must trace true owner and credit to dormant account after KYC, not keep in Suspense.
Scenario 2: Dormant accounts misused to clear Suspense or launder money.
This is the fraud typology RBI warns about. Fraudsters identify dormant accounts not operated for years, and use them to route proceeds of forged cheques/ fraud, then show clearance from Suspense.
Therefore, Dormant Suspense Clearance Policy means:
- Daily review of Suspense GL by officer not authorized to post transactions [Maker-Checker]
- No credit to dormant account without approval of Branch Head + Operations Head
- No debit to dormant account without fresh customer identification
- Auto-transfer of balance lying inoperative for 10 years to DEAF - Depositor Education and Awareness Fund maintained with RBI as per Section 26A of Banking Regulation Act. Customer can still claim from DEAF later.
PART C: STANDARD OPERATING PROCEDURE [SOP] FOR CLEARANCE
Step 1: Identification
System generates report: SUS-01 [Suspense > 3 days] + DORM-01 [Dormant accounts with transactions in last 7 days]
Step 2: Investigation
- Check source document - where did credit come from? Cheque, NEFT UTR, ATM batch?
- Contact originating bank/branch
- Verify KYC and reason for dormancy
Step 3: Approval Matrix
- Up to Rs. 10,000 - Officer
- Rs.10,001 to 1 lakh - Branch Manager + Operation Manager
- Above Rs.1 lakh - Zonal Office, with reasoned note
Step 4: Clearance Entry
Debit Suspense - Credit Customer's Dormant Account with narration "TRF FROM SUSPENSE GL XX UTR NO... DORMANT REACTIVATION APPROVED BY..."
Step 5: Reporting
- Report to Concurrent Auditor same day
- Monthly report to Controllership for items >30 days in Suspense
Violation = Staff accountability + Audit objection under GHODAWALA Classification.
PART D: CASE LAWS
A. On Dormant Account Fraud and Liability of Holder
1. Kaushik Palicha vs State - Madras High Court, W.P. No. ... Order dated 30.08.2024 - Reported by The Hindu & Hindustan Times
Facts: Petitioner was holder of a dormant bank account which was not operated for a long time. A gang deposited a forged cheque of Rs.9.99 crore in the name of a Madhya Pradesh-based company into his dormant account. Bank's internal fraud team identified that dormant accounts which were not put to use by customers were targeted for transactions.
Held by Justice N Anand Venkatesh:
- The dormant account holder cannot be made an accused merely because his account was used. He is at best a witness, not an accused.
- The court quashed criminal case against holder.
- Court observed: "Dormant accounts which were not put to use by the customers concerned for a long time, were also identified and an attempt was made to transact money through such dormant accounts"
Principle: Banks have higher duty to monitor dormant accounts. Victim of identity theft / misuse of dormant account cannot be criminally liable.
2. Calcutta High Court - SBI Freezing Mule Account Case - September 2026
Calcutta High Court held mere suspicion of 'Mule Account' is insufficient to freeze account. Bank must have evidence of fraud, cannot arbitrarily freeze dormant accounts under guise of mule account monitoring without following RBI procedure of informing customer. Bank directed to defreeze.
B. On Suspense Account Misuse - Embezzlement
3. Internal Control Failure Case - US Claim - $1.3 Million Embezzlement via Suspense Account - Progressive Insurance Report
One of the most cited internal control cases for auditors.
Facts: Long-tenured head teller used suspense account to embezzle $1.3MM over several years - beginning with small amounts she would "borrow" and pay back, until gambling debts mounted.
Principle Established in Banking Audit Standards: One of the most important internal controls is ensuring suspense accounts are monitored regularly and reconciled by someone who cannot post transactions to the account. This became RBI guideline for maker-checker.
4. Principal Commissioner of Income Tax-5 vs Shri Mahila Sewa Sahakari Bank Ltd, Gujarat High Court - 05 Aug 2016
Facts: Bank credited interest on "sticky advances" [NPA] to Interest Suspense Account instead of P&L, claiming it was not realizable.
Held: Method of accounting interest suspense is permissible for banking companies as per RBI circular of 06-10-1952. Interest taken to suspense account cannot be treated as income until actually recovered. This validates the Interest Suspense mechanism.
5. State Bank of India vs M/s UCO Bank type matters - Interest Suspense Accounting - Indiankanoon - 1981-82 Assessment
Held: In such cases, interest calculated on loan amount is credited in a suspense account. This amount is not brought to profit and loss account because these are amounts not likely to be realised. This is accepted banking practice.
C. On DEAF Transfer and Unclaimed Deposits
6. RBI Circular - Depositor Education and Awareness Fund Scheme 2014
Any credit balance in any inoperative account for 10 years or more must be transferred to DEAF within 3 months after expiry of 10 years. Bank must maintain customer-wise details. Customer can claim refund anytime with interest @4% from bank, bank in turn claims from RBI.
Failure to transfer to DEAF is penalized - RBI imposed penalties of Rs. 1 Cr+ on several PSBs in 2023-24 for non-transfer.
PART E: RED FLAGS FOR AUDITOR
As per RBI Concurrent Audit Checklist:
- Same dormant account credited multiple times from suspense in short period
- Round figure credits to dormant account from suspense
- Dormant account reactivated, large credit from suspense, immediate withdrawal via ATM in different city
- Suspense balance not cleared >7 days, justification "customer not traceable" - must be escalated, not allowed to continue
