Double Debit Due To Network Retry Errors .
1. What Happens Technically?
A payment has 4 legs: You -> Payment Gateway / UPI App -> Acquiring Bank -> Issuing Bank -> NPCI / Card Network
Failure Scenario:
- You press Pay. Request goes to gateway.
- Issuing bank debits your account and sends success, but network timeout drops the response.
- Gateway / App does not receive success. It marks transaction as Pending / Failed.
- App's retry logic or you manually pressing Pay again sends Request 2.
- Issuing bank processes Request 2 as new transaction - debits again.
- Result: One delivery, two debits with either same RRN / UTR or two different UTRs within seconds.
This is called Non-Idempotent API handling. A payment API must be idempotent - same Idempotency-Key should not create second debit. Many PSPs fail to implement it.
There are 2 legal types:
Type A - Failed Transaction Double Debit: Your account debited but beneficiary not credited, then you retried and got debited again and second one succeeded. First one is failed, second is successful.
Type B - Ledger Duplicate Posting: Same reference number posted twice to your savings account. Single authorization settled twice. This is pure bank error, not a payment failure.
RBI treats them differently.
2. RBI Regulatory Framework
A. RBI Circular RBI/2019-20/67 dated 20 Sep 2019 - Harmonisation of Turn Around Time (TAT) and Customer Compensation for Failed Transactions
This is the main law for Type A.
- UPI P2P: If your account debited but beneficiary not credited, auto-reversal by T+1 day
- UPI Merchant / Card PoS / e-Com / IMPS: Auto-reversal by T+5 days
- ATM cash not dispensed: T+5 days
- If bank fails to reverse within TAT, it must pay Rs 100 per day compensation suo motu, without you claiming.
- T = transaction date
For merchant payments where confirmation not received at merchant, prescribed reversal is T+5.
B. RBI Customer Protection - Limiting Liability Circular 2017
If unauthorized / erroneous double debit, zero liability if reported within 3 working days of receiving communication. Bank must credit shadow reversal within 10 days.
C. For Type B Ledger Duplicate:
TAT circular does NOT apply. RBI says that rule applies only to failed ATM, UPI, IMPS, card-present transactions where cash not dispensed or funds did not reach beneficiary. A pure duplicate posting is a bank error under general customer service norms and RB-IOS 2026, with no fixed per-day compensation. You must demand value-dated reversal - bank must restore account as if second debit never happened, including reversing any bounce charges.
3. Why It Is Deficiency in Service - Case Laws
1. Sri G. Puttaswamy vs The Manager, Union Bank of India - CC No. 347/2023, Bangalore III Additional District Commission Order 20.06.2024
Facts: Complainant attempted to withdraw Rs 5,000 and Rs 3,000 from Union Bank ATM. No cash dispensed but both amounts debited. Bank did not appear.
Held: Bench noted statement showing deduction on 26.04.2023, bank did not dispute evidence. Error was on part of bank. Directed bank to reimburse Rs 8,000 with 9% p.a interest, plus Rs 3,000 compensation for mental distress and litigation costs
This principle is applied to UPI double debits - wrongful debit without service is deficiency under Consumer Protection Act 2019 Sec 2(11).
2. National Commission Precedent - HDFC Bank V/s Narendra Kumar Agarwal and Deputy General Manager V/s Sham Kumar Sharma
NCDRC held wrong debit entry gives recurring cause of action and bank's failure to reverse after notice is deficiency. Limitation starts from date bank finally refuses.
3. RBI Integrated Ombudsman Scheme, 2026 (RB-IOS 2026)
Under RB-IOS 2026 clause 8(3), for duplicate debit you can claim:
- Up to Rs 3 lakh for loss of time, harassment, mental anguish
- Up to Rs 30 lakh for consequential financial loss like bounced EMI, cheque bounce due to double debit
4. Double Debit on UPI - Moneycontrol / ET precedent
Courts have held second payment creating duplicate debit if original eventually goes through must be reversed. "A second payment can create a duplicate debit if the original transaction eventually goes through" - banks must ensure idempotency checks.
4. How to Get Money Back - Correct Legal Steps
Step 1: Do NOT retry if status is Pending. Pending can still complete. Retrying means you may pay twice.
Step 2: Proof Collection
- Same RRN/UTR or same amount same date same merchant
- Single invoice / delivery proof
- Bank statement PDF with both debits highlighted
Step 3: Written Complaint Day 1
Demand in writing: "Reverse second debit of Rs X dated Y, reference Z, with original value date, and reverse consequential charges."
Value date is critical - if bank credits today but leaves wrong value date, interest and bounce charges stay.
Step 4: Escalation
- If no reversal in T+1 / T+5 as per RBI TAT, ask for Rs 100/day compensation
- After 30 days, file with RBI Ombudsman at cms.rbi.org.in within 90 days
Step 5: Legal Notice
Under Consumer Protection Act, 2019 you can file before District Commission for deficiency in service, seeking refund + interest + compensation for harassment.
For Merchants / PSPs: Implement idempotency-key, disable retry button for 60 seconds after failure, use NPCI UDIR (UPI Dispute and Issue Resolution) and card network chargeback reason code 12.6.1 Duplicate Processing.
