Failure To Provide Alternate Invoice Formats On Request .
1. What Does Alternate Invoice Format Mean?
GST law prescribes contents, but NOT single format. Customer can request on reasonable grounds:
A. GST Alternate Formats:
- Physical paper copy vs PDF
- e-Invoice with IRN/QR Code under Rule 48(4) - mandatory for turnover > Rs.5 Cr
- B2B customer needs e-invoice JSON for ITC matching - McLeod Russel India Ltd vs UOI (Gauhati HC 2025) held buyer's responsibility is to ensure supplier has valid GST registration, proper tax invoice as per Rule 46
- Tax invoice in Hindi/regional language
- Bill of Supply vs Tax Invoice under Rule 49
B. Accessibility Alternate Formats - NEW LAW:
- Screen-reader friendly PDF / HTML
- Large print
- Braille
- Audio / Voice-enabled invoice
- Easy-to-read format
C. Commercial Alternate Formats:
- Proforma, Commercial Invoice for export
- Invoice with HSN summary for customs
If customer requests and you refuse, it is failure.
2. Legal Obligations
GST Law:
Rule 46 - Tax Invoice must contain: Supplier name, GSTIN, consecutive serial number not exceeding 16 characters, date, recipient GSTIN, HSN, value, tax.
Rule 48 - e-Invoicing: If turnover > Rs.5 Cr, invoice without IRN/QR Code is NOT a valid invoice. In VLM Group v. Addl Commissioner (GSTAT Lucknow 28 Sept 2026) Tribunal held e-invoice lapse without proven tax evasion cannot justify penalty, but invoice lacked prescribed IRN/QR Code - authorities noticed invoice did not contain IRN.
Rule 46(b) - consecutive serial number... Buyer cannot be denied ITC if supplier fails to provide proper invoice format - Karnataka HC Circular 183/15/2022-GST case - ITC mismatch due to non-filing of GSTR-1 by supplier must be resolved per CBIC procedure.
Consumer Law: Under Consumer Protection Act 2019 Sec 2(11) deficiency includes any fault in providing service. Failure to provide proper invoice that allows customer to claim warranty, ITC, reimbursement = deficiency.
Disability Law - MOST IMPORTANT NEW DEVELOPMENT:
Supreme Court in Pragya Prasun & Ors. v. Union of India & Amar Jain v. Union of India, 2025 INSC 599, decided 30 April 2025 - Landmark.
Facts: Acid-attack survivors with facial disfigurement and person with 100% blindness unable to complete digital KYC/e-KYC procedures due to protocols requiring blinking, live photo.
Supreme Court Held (Justice J.B. Pardiwala and Justice R. Mahadevan):
- Digital accessibility is integral part of fundamental right under Article 21
- It is mandatory for all Government websites to adhere to Section 46 of RPwD Act which requires both electronic and print media to be accessible to persons with disabilities. All online services including e-governance platforms, digital payment systems must be accessible
- 20 Directions issued:
- Accessible Formats for Documentation: All forms, applications, and documents used in KYC and digital services must be available in accessible formats, including screen-reader-friendly digital files, large print, Braille
- Alternative formats including braille, easy-to-read formats, voice-enabled services to disseminate government notifications and deliver public services to be made available
- Continuation of paper-based KYC as accessible alternative
- Public services must provide information in alternative formats - including Braille, easy-to-read formats, and audio-described content
This judgment directly applies to invoices. Invoice is a public document under Sec 12 RPwD Act.
3. Case Laws on Failure To Provide Invoice Formats
Case Law 1: Pragya Prasun Case (SC 2025) - Alternate Format = Fundamental Right
Citation: W.P.(C) No.289/2024 & 49/2025, 2025 SCC OnLine SC 993
Ratio: Failure to provide documents in accessible formats violates Art 14, 19, 21 and Sec 12 RPwD Act which says Take steps to ensure that all public documents are made available in accessible formats
Implication for you: If blind customer asks for invoice in screen-reader PDF or audio, refusal = constitutional violation. Can file PIL under Art 32.
Case Law 2: Nitesh Gupta v. State of UP & Ors - Allahabad HC - Writ C No.19802/2021
Petitioner is suffering from total blindness by birth and thus suffering from cent percent disability. Contended under Section 12 of Rights of Persons with Disabilities Act, 2016 it is imperative for appropriate Government to take steps to ensure that all public documents are made available in accessible formats
HC called for State reply. Followed later by SC in Pragya Prasun.
Case Law 3: GST - Nancy Trading Company v. State of UP [Writ Tax No.892/2023, Allahabad HC 15 July 2024]
Goods detained because e-tax invoice not generated. HC quashed detention and penalty order under Sec 129 CGST Act on ground that missing e-tax invoice was bonafide human error and there was no intent to evade tax, and all other required documents were in order.
Principle: Detention occurred because e-tax invoice required under Rule 48 not generated. If consignment accompanied with invoice or any other specified documents, proceedings under Sec 129 may not be initiated.
For alternate formats: If customer asks for e-invoice with QR and you give only paper invoice, you are not compliant.
Case Law 4: F S Enterprise vs State of Gujarat (Gujarat HC)
Goods detained on ground transport receipt photocopy handwritten. Assessee argued no specific format for transport receipt prescribed under GST law, detention arbitrary. HC held detention invalid as invoice & e-way bill properly furnished.
Shows: If GST law does NOT prescribe single format, any reasonable format containing Rule 46 particulars valid. But if customer needs specific format for compliance, refusal = deficiency.
Case Law 5: Consumer Case - Small Business Fined $10,000 - Australian GST Invoice Requirements
Though foreign, cited in Indian consumer forums: In a recent case, small business owner fined $10,000 for repeatedly issuing incorrect invoices that did not comply with GST requirements. Failure to comply with GST invoice requirements may result in penalties under Taxation Administration Act
Indian parallel: Sec 122(1)(i) CGST Act - issuing incorrect/false invoice liable to penalty Rs.10,000.
Case Law 6: Archana Textile Corporation vs State of Maharashtra (Bombay HC) - Fake Invoices
Failure to mention allegations of fake invoice in SCN invalid. SCN issued did not contain details of sales, claims. Court held not providing details of fake invoices & forms with SCN is serious lapse.
Reverse application: If you fail to provide proper invoice, you enable fake invoice allegation.
4. When Does Failure Become Actionable?
Actionable if:
B2B customer requests e-invoice JSON/QR under Rule 48 and you give only paper - He loses ITC Rs.18 lakhs. He can sue for damages + file GST complaint.
Export customer requests commercial invoice with currency, but you give domestic tax invoice only - Customs will not clear.
Blind customer requests screen-reader accessible invoice under RPwD Act Sec 12 & 46, you refuse - File complaint before State Commissioner for Persons with Disabilities + Consumer Commission + SC writ.
Employee requests salary invoice in accessible format - Employer violates Sec 7 DPDP Act legitimate uses.
5. How to Comply - SOP
For Businesses (Turnover >5 Cr):
- Issue e-invoice with IRN/QR as per Rule 48 - auto-generate
- Also provide PDF + JSON on request within 24 hours - Free
- Keep API for customers to download in Excel/CSV
For All Businesses - Accessibility Compliance after Pragya Prasun 2025:
- PDF must be tagged, not scanned image - Must pass WCAG 2.1 AA
- On request, provide in 3 days:
- Large print (18pt)
- Screen-reader HTML version
- Audio invoice via IVR/email
Failure penalty after 2025:
- Under RPwD Act Sec 89-93 - Fine up to Rs.5 lakhs + imprisonment
- Under DPDP Act 2023 Sec 33 - up to Rs.250 Cr for failure to provide data principal rights
- Under Consumer Protection Act - Compensation + Punitive damages
After Pragya Prasun, "We only provide PDF" is no longer defence. Alternate format is fundamental right.
