Failure To Provide Drill-Down For Consolidated Billing .
Failure To Provide Drill-Down For Consolidated Billing
This means issuing a single lump-sum invoice - "Total Due: Rs 1,25,000" - without giving the customer the ability to see what that total is made of, which service / account / meter / user consumed it, and how it was calculated.
A consolidated bill without granular backup is legally treated as a non-speaking demand and a deficiency in service.
A consolidated bill is legal only if it has two layers:
- Summary invoice - total due
- Detailed allocation report / drill-down - breakup by account, location, service, usage, taxes.
Failure to provide Layer 2 = Opaque billing.
Where It Is Mandatory To Provide Drill-Down?
1. Telecom - TRAI
TRAI Telecom Consumers Protection Regulations 2012 + Standards of Quality of Service Regulations 2009:
- Operators must provide itemized bill on request for postpaid.
- For prepaid, on request for any period in preceding 6 months, operator must provide itemized usage.
- TRAI mandates itemised billing for cable TV and has cracked down on hidden charges - operators must inform every time an amount is charged.
Failure: Delhi State Consumer Commission in Smt. Jain vs Telecom Operator (2005) observed private telecom operators overcharging by including undue charges - like Hello Tune - which are not rectified unless subscriber points out. Commission sought TRAI help.
Also Reliance Communications case - Order Jan 10, 2019 - S K Kakade Bench: Commission held it is mandatory to serve bill upon consumer, cannot force e-billing without consent, and if detailed billing was opted for at Rs 50/month, operator must provide it.
2. Electricity - Electricity Act & DERC / State Regulations
Under Section 56 Electricity Act + Regulations:
- Bill-cum-notice for arrear under assessment or charges levied as result of checking shall be initially tendered separately and shall not be clubbed with current electricity bill.
- No sum due recoverable after 2 years unless shown as arrears continuously.
Case Laws:
a) Y.N. Gupta vs Delhi Electricity Supply Undertaking - NCDRC 16 Nov 1992
Held: It was deficiency in service that bills were not prepared and served at appointed time and thereafter harassing consumer with heavy arrears bill. It was deficiency to raise bills without actual meter reading and to raise arrears bill without details.
b) PSPCL vs Satish Kumar - Consumer Complaint No. 297 of 2015 - Decided 02.11.2017
Forum held clubbing of arrears with current bill without separate notice is illegal. Arrear bill must be tendered separately.
c) BSES Rajdhani vs Bishan Devi - State Commission 18 Nov 2008
Reaffirmed Section 56: Licensee cannot recover sum after 2 years if not shown as arrears and cannot disconnect without proper breakup.
d) Allahabad HC - M/s Om Food Manufacturing Center vs State of UP - Writ-C No.12303 of 2026 - 06 May 2026
Quashed Rs 62 lakh retrospective demand raised 2 years after billing error because company made billing error in tariff. Court held no detailed drill-down given at time of original billing.
3. Housing Society / Commercial Complex
Model Bye-laws of Cooperative Housing Societies Maharashtra: Technically bye-laws do not mandate detailed break-up in every bill, but General Body can direct Managing Committee to issue bills with detailed break-ups for transparency. NCDRC in multiple cases held consolidated maintenance bill without breakup of sinking fund, repairs, water, property tax = deficiency if member demands.
4. Healthcare - USA & India
Under US No Surprises Act + Hospital Price Transparency Rule, hospital must provide itemized bill within 30 days of request. Many hospitals don't send itemized bill unless asked, but legally required. Indian Clinical Establishments Act - similar. Failure is treated as unfair trade practice.
5. Cloud / SaaS / Enterprise Consolidated Billing
AWS, Azure, GCP consolidated billing across linked accounts must provide Cost Explorer drill-down by account ID, service, region, tag. Contracts usually say: "Vendor shall provide reasonable billing detail upon request." Failure = breach of contract and right to withhold disputed portion.
Legal Consequences of Not Providing Drill-Down
Under Consumer Protection Act 2019 - Sec 2(11) Deficiency in Service and Sec 2(47) Unfair Trade Practice: Raising bill without meter reading, without breakup, clubbing arrears is deficiency. Consumer can seek revision of bill on actual consumption basis of 6 months prior.
Right to Withhold: Under Law Insider sample clauses - "shall provide all further reasonable billing detail upon request." If not provided, customer can withhold disputed portion without being in default.
Limitation: If you don't show amount as arrears with drill-down, you lose right to recover after 2 years - Sec 56 Electricity Act.
Penalty by Regulator: TRAI can impose financial disincentive Rs 50k per violation for not providing itemized bill. IRDAI, CERC similar.
How to Comply / How to Demand?
If you are vendor issuing consolidated bill:
- Always provide: Summary + CSV / portal with filters - by meter / account / user / date / rate / tax / discount.
- Mention: Previous reading, current reading, unit rate, slab, fixed charges, arrears separately.
- Keep records for 6 months for prepaid telecom, 2 years for electricity.
If you are customer receiving opaque bill:
Send legal notice citing:
- TRAI Regulation 2012 Clause 4 - itemized bill on demand
- NCDRC Y.N. Gupta vs DESU
- PSPCL vs Satish Kumar - no clubbing
- Consumer Protection Act Sec 2(11)
Prayer: Direct OP to rectify disputed bill and send revised bill on actual consumption basis without levying surcharge, plus compensation for harassment.
