Failure To Publish Adequate Auction Notice .
1. What is Adequate Notice?
Under Security Interest (Enforcement) Rules, 2002:
Rule 8(6): The authorised officer shall serve to the borrower a notice of 30 days for sale of immovable secured assets under Rule 8(5).
Proviso: If sale is by public auction or inviting tenders, secured creditor shall cause a public notice in two leading newspapers, one in vernacular language having sufficient circulation in the locality by setting out terms of sale, including:
- Description of property with boundaries
- Reserve price fixed after valuation under Rule 8(5)
- Date, time, place of auction / tender opening
- Earnest money deposit
- Known encumbrances
Rule 9(1): No sale of immovable property shall take place before expiry of 30 days from date on which public notice published in newspapers OR notice served to borrower, whichever is later.
Adequate =
- Individual 30-day clear notice to borrower + guarantor
- Public notice in 2 newspapers with full details
- Fresh 30-day notice if sale postponed beyond 30 days
- Reserve price, valuation, encumbrances disclosed
Failure of any limb = inadequate notice.
2. Legal Consequence
- Sale null and void being in violation of Sec 13 SARFAESI Act and Rules 8 & 9
- Borrower's right of redemption under Sec 13(8) extinguished only on publication of valid auction notice - if notice invalid, redemption survives
- Statutory notice mandatory under SARFAESI
3. Leading Case Laws

3. Celir LLP vs Bafna Motors (Mumbai) Pvt Ltd, 2023 SCC OnLine SC 1209
Borrowers defaulted, account NPA. SC deliberated extent of right to redemption under Sec 13(8).
Held:
- As per amended Sec 13(8) (2016 amendment), borrower's failure to tender full dues before publication of auction notice results in extinguishment of right to redeem from date auction notice published.
- Therefore validity of publication date is crucial - if notice inadequate, redemption not extinguished.
B. What is Not Adequate
4. E.K. Rajan vs Authorized Officer - Kerala High Court (TaxGuru Report)
Since there was failure to serve notice of not less than 15 days (pre-2016 rule, now 30 days), notice of sale proposing to auction property was bad in law and consequent sale liable to be set aside. Rule 9 still stipulates 30 days clear notice at first instance
5. Govind Kumar Sharma vs Bank of Baroda - SC 2024-25
SC upheld HC, DRAT, DRT decisions to set aside auction sale due to bank's failure to comply with mandatory notice requirements. Although borrowers used delaying tactics for first two auctions, that conduct does not amount to waiving mandatory requirement of publishing subsequent notice fixing fresh date
6. Sterling Holiday Resorts Ltd vs M/s P.M. Associates, 2026 INSC 1071 - Supreme Court 30 Sept 2026
Latest. Court set aside SARFAESI auction because Rule 8(6) read with Rule 9(1) breached because borrower got no notice of bid-opening. Held Rule 9(1) 30-day period protects redemption. Inadequate publication = sale invalid.
7. M.R. Vasumathi vs Authorized Officer, 2026 INSC 633 - Civil Appeal 1606 of 2026
