🇧 Legal System Overview

 The Bahamas operates under a common law system, influenced by English legal tradition.  The judiciary is independent, with the Supreme Court of The Bahamas serving as the highest cour.  The legal profession is regulated by the Bahamas Bar Association, which oversees the admission and conduct of attorney.  

🎓 Admission Requirement

 To practice law in The Bahamas, individuals must be admitted to the Bahamas Br   Admission is primarily reserved for Bahamian citizens, with specific provisions for foreign attorneys seeking temporary admission.  

*General Admission (for Bahamian citizens):

 Bahamian applicants must submit the following documents to the Bar Council at least six weeks before their intended date of Cal:  

.  A cover letter, including contact information and the name and date of Call of the present.  

.  One original and ten copies f: 

 A signed and undated petition.

 An affidavit in support, including: 

Curriculum vitae.

Copies of certificates.

First four pages of the passport.

Three-character references: two from current Bahamas Bar Association members with at least five years of Call, and one from a non-lawyer.

A police certificate from the Royal Bahamas Police Force.

 An affidavit pursuant to Section 12 of the Legal Profession At. 

 An affidavit of authenticity.  

.  A non-refundable processing fee of $10. 

 All documents must be submitted in the prescribed format, and applications that do not adhere to these guidelines will not be accepted.  

*Special Admission (for foreign attorneys):

 Foreign attorneys seeking to represent clients in The Bahamas must apply for special admission. The application must include:  

.  A letter of application.  

.  An affidavit by local counsel detailing: 

 The parties involved.

 The nature and stage of the matter. 

 The complexity of the matter. 

 Evidence of the non-availability of local counsel. 

 Evidence that the interests of justice will be served.  

.  Two character references.  

.  A certificate of good standing from the foreign Br.  

.  A curriculum Vite.  

.  A non-refundable processing fee of $1,00.  

.  Evidence that opposing counsel has been informed of the intention to apply.

 Once admitted, attorneys are required to adhere to the ethical standards set forth in the *Bahamas Bar Code of Professional Conduct.   This includes maintaining client confidentiality, avoiding conflicts of interest, and upholding the integrity of the legal profession.   Attorneys are also expected to engage in continuous professional development to stay abreast of legal developments.
