Geographical Indications Law in Iraq

Iraq's legal framework for geographical indications (GIs) is integrated within its broader intellectual property (IP) laws, specifically under the Trademark and Geographical Indications Law, which is an amendment to the original Trademarks and Descriptions Law No. 21 of 1957. This amendment was enacted by Order No. 80 on April 26, 2004, during the period of the Coalition Provisional Authority. 

Key Features of Iraq's GI Law

Scope of Protection: The law extends protection to geographical indications, which are defined as signs that identify goods as originating from a specific place, where a given quality, reputation, or characteristic of the goods is essentially attributable to their geographical origin.

Legal Framework: The law encompasses various aspects of IP, including trademarks, trade names, and geographical indications, thereby providing a comprehensive approach to IP protection in Iraq.

Enforcement and Registration: The Ministry of Industry and Minerals, through the Department of Trade Marks & Geographical Indication, is responsible for the registration and enforcement of GIs in Iraq. This department operates under the legal provisions set forth in the amended law.

International Treaties and Iraq's Participation

Paris Convention: Iraq is a member of the Paris Convention for the Protection of Industrial Property, which facilitates international cooperation in the protection of industrial property, including geographical indications.

Lisbon Agreement: Iraq is not currently a member of the Lisbon Agreement for the Protection of Appellations of Origin and their International Registration, which provides a system for the international registration of geographical indications.

Challenges and Considerations

While Iraq has established a legal framework for the protection of geographical indications, challenges remain in terms of enforcement, public awareness, and alignment with international standards. Continued efforts are needed to strengthen the implementation of GI protections and to enhance Iraq's participation in international IP treaties.
