Immigration Law at Ghana

Immigration law in Ghana is governed primarily by the Immigration Act, 2000 (Act 573) and its amendments, as well as various regulations issued by the Ghana Immigration Service (GIS). These laws regulate the entry, residence, employment, and removal of non-citizens.

Key Aspects of Ghana’s Immigration Law

1. Entry Requirements

All visitors to Ghana must possess a valid passport and may require a visa, unless they are from ECOWAS countries or other visa-exempt nations.

Visa types include: Tourist, Business, Student, Transit, and Diplomatic visas.

Visa on Arrival is available under specific conditions (usually pre-approved).

2. Residence Permits

Foreign nationals staying in Ghana for more than 90 days must obtain a residence permit.

Types of residence permits:

Work and Residence Permit (for foreign employees)

Dependent Residence Permit (for family members)

Student Residence Permit

Applications go through the Ghana Immigration Service, and employment-related permits also require approval from the Ministry of the Interior.

3. Work Permits

Work permits are required for foreign nationals seeking employment in Ghana.

The employer typically applies on behalf of the employee.

Work permits are not the same as residence permits—both are required.

4. Right of Abode

Ghana offers a Right of Abode status to people of African descent in the diaspora, allowing them to live and work in Ghana indefinitely.

This is part of Ghana’s broader initiative to reconnect with the African diaspora.

5. Citizenship

Ghana allows citizenship by birth, registration, or naturalization.

Dual citizenship is permitted under certain conditions, though dual nationals may not hold certain public offices.

6. Enforcement & Penalties

Overstaying a visa or residence permit can result in fines, detention, or deportation.

The GIS conducts compliance checks and enforces penalties for violations.
