 Kenya's IP system is governed by several key laws and regulations

Trade Marks Act: Addresses the registration and protection of trademarks 

Anti-Counterfeit Act: Focuses on combating counterfeit goods   The Kenya Industrial Property Institute (KIPI) is the central authority responsible for the registration and enforcement of industrial property rights, while the Kenya Copyright Board (KECOBO) oversees the protection of copyrights  

📄 Types of IP Protection

1. Patents

Eligibility Inventions that are new, involve an inventive step, and are industrially applicable. 

Types  Standard patents (20 years) and utility models (10 years.

Application Process  File an application with KIPI, detailing the invention's novelty and industrial applicability. 

2. Trademarks

Eligibility  Signs capable of distinguishing goods or services of one enterprise from those of another.

Duration  10 years, renewable indefinitely. 

Registration Process Submit an application to KIPI, which examines the mark for distinctiveness and potential conflict. 

3. Copyrights

Protection Automatic upon creation of original works in the fields of literature, science, and the art. 

Duration  Life of the author plus 50 year.

Registration  Voluntary but provides legal benefits, including a presumption of ownership and easier enforcement.

4. Industrial Designs

Eligibility  Aesthetic aspects of a product that are new and original. 

Duration  5 years, renewable up to 15 years.

Application Process  File an application with KIPI, including representations of the design and proof of novelty. 

5. Trade Secrets

Protection  Confidential business information that provides a competitive edge. 

Duration  As long as the information remains confidential. 

Protection Mechanisms Non-disclosure agreements and internal security measure. 

🌐 International Treaties

 Kenya is a member of several key international IP treaties, including: 

Paris Convention for the Protection of Industrial Property

Berne Convention for the Protection of Literary and Artistic Works

Marrakesh Agreement Establishing the World Trade Organization

*Marrakesh Treaty:  Facilitates access to published works for persons who are blind, visually impaired, or otherwise print disabled.

*Civil Actions:  Filing lawsuits in civil courts for infringement.

*Criminal Actions:  Penalties, including fines and imprisonment, for serious infringements.
