Intellectual Property Laws at Saint Kitts and Nevis

Saint Kitts and Nevis has made significant strides in modernizing its intellectual property (IP) laws to foster creativity and innovation. Here's an overview of the current IP framework:

📜 Copyright Law

Modernization: In May 2024, the Copyright Bill, 2024, was enacted, replacing the previous Copyright Act, Cap 18.08 (2000). This update aligns with international standards and supports the nation's growing creative industries

Key Provisions:

Duration: Copyright protection now extends to 70 years after the author's death, up from the previous 50 years

Digital Works: Protection is granted to digital and ephemeral works, including internet streaming and digital reproductions

Collective Management: Establishes frameworks for collective management organizations to ensure fair distribution of royalties

Folklore: Recognizes traditional cultural expressions, with rights vested in the Crown if the author is unknown

🛡️ Trademark Law

Registration Trademarks must be distinctive and not conflict with public order or morality.

Grounds for Refusal:

Distinctiveness Marks must distinguish goods or services effectively.

Public Order Marks should not be contrary to public order or morality.

Misleading Marks Marks that could mislead the public, especially regarding geographical origin, are not registrable.

Emblems Marks identical to state emblems or official signs require authorization.

Well-Known Marks Marks identical or confusingly similar to well-known marks may be refused registration.

🏭 Industrial Designs

*Hague Agreement: Saint Kitts and Nevis acceded to the Geneva Act of the Hague Agreement on October 8, 2024, becoming the 80th contracting party.

*Protection Duration: Industrial designs are protected for up to 25 years.

⚖️ Enforcement and Legal Proceedings

*Jurisdiction: IP disputes are adjudicated in the courts of Saint Kitts and Nevis.

*Remedies: Available remedies include injunctions, damages, and account of profits.
