What does Section 226 say?

If a person is wrongfully confined or restrained (i.e., illegally kept in custody or imprisoned),

The High Court has the power to release that person through a writ of habeas corpus or other appropriate writs,

This applies regardless of whether the confinement is by public officials or private individuals.

Why is this important?

Protects individual liberty and safeguards against illegal detention.

Ensures courts can intervene quickly if someone is unlawfully held.

Habeas corpus literally means "you shall have the body," demanding the authority to produce the detained person before the court.

Example:

If someone is arrested without proper legal procedure and kept in custody unlawfully, they or someone on their behalf can approach the High Court under Section 226 to secure their release.
