IPC Section 252

IPC Section 252 pertains to the possession of a coin that has been altered, where the possessor is aware of the alteration at the time of acquiring it.

"Possession of coin by person who knew it to be altered when he became possessed thereof.
Whoever fraudulently or with intent that fraud may be committed, is in possession of coin with respect to which the offence defined in either of sections 246 or 248 has been committed, having known at the time of becoming possessed thereof that such offence had been committed with respect to such coin, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine."

Fraudulent Intent: The individual must possess the coin with the intent to commit fraud or with the knowledge that fraud has been committed.

Knowledge of Alteration: The person must be aware at the time of acquiring the coin that it has been altered in a manner described in sections 246 or 248.

Alteration Offenses: These refer to specific offenses where coins are fraudulently altered, such as:

Section 246: Fraudulent alteration of coins.

Section 248: Fraudulent possession of altered coins.

Punishment: The offense is punishable with imprisonment for up to three years and may also include a fine.

Suppose an individual knowingly accepts a coin that has been shaved or clipped (altered) and intends to use it in transactions. If it's proven that the person was aware of the alteration at the time of possession, they could be charged under Section 252 IPC.

๐Ÿ”„ Transition to Bharatiya Nyaya Sanhita (BNS)

As of July 1, 2024, the Indian Penal Code (IPC) was replaced by the Bharatiya Nyaya Sanhita (BNS), 2023. Under the new framework:

Section 252 IPC has been repealed.

The offense previously covered under Section 252 is now addressed under BNS Section 180.

The BNS aims to streamline and modernize criminal law, consolidating various provisions and introducing updated procedures and punishments.
