Section 403 – Dishonest misappropriation of property

"Whoever dishonestly misappropriates or converts to his own use any movable property shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both."

Misappropriation: Wrongfully taking or using someone else’s movable property for one’s own use.

Dishonest intention is essential — the person must intend to convert the property for their own benefit without the owner’s consent.

Movable property: Any property that can be moved (like money, goods, belongings).

Difference from Theft (Section 378):

Theft involves taking property dishonestly.

Misappropriation involves already having possession of the property (lawfully or otherwise) but dishonestly converting it to one’s own use.
