IPC Section 443
IPC Section 443 – Making Preparation to Commit Mischief
Purpose
This section aims to prevent mischief before it occurs. It punishes anyone who prepares or plans to commit mischief, even if the actual mischief has not yet been carried out.
Provision
Whoever makes or prepares anything with the intention of committing mischief,
Shall be punished with imprisonment up to 6 months, or fine, or both.
Key Points
Mischief (Sec 425 IPC) → Causing destruction, damage, or alteration of property intentionally.
Section 443 deals with the preparatory act, not the actual damage.
The act must show intent to commit mischief.
Punishment is less severe compared to actual mischief because the offence is preventive.
Example
A person buys chemicals and tools intending to damage a neighbor’s crops.
Even if he hasn’t yet destroyed the crops, this preparatory act can be punished under Section 443 IPC.
Another example: Someone digs a trench intending to flood the neighbor’s land, but has not yet done so.
In Short
Section 443 IPC punishes preparations to commit mischief.
Punishment = up to 6 months imprisonment, fine, or both.
It is a preventive measure to stop property damage before it occurs.
