IPC Section 82 – Act of a Child Under Seven Years of Age

Text of IPC Section 82:

"Nothing is an offence which is done by a child under seven years of age."

Explanation:

A child below 7 years old is considered incapable of committing a crime under Indian law.

This legal principle is based on the doctrine of doli incapax — Latin for "incapable of evil".

The law assumes that a child under 7 lacks the mental capacity to understand the nature and consequences of their actions.

If a 6-year-old child accidentally causes harm or even death while playing, no criminal liability arises under IPC. The act is not considered an offence.
