1. Governing Law

Patent protection in Kuwait is governed by Law No. 64 of 2010 on Patents, Industrial Designs and Integrated Circuits Layout-Designs, which came into effect in 2011.

The law is administered by the Kuwait Ministry of Commerce and Industry, specifically through the Kuwait Patent Office.

2. Types of Protection

Patents for inventions

Utility models (sometimes known as petty patents)

Protection also extends to industrial designs and integrated circuit layouts.

3. Patentability Requirements

To be patentable, an invention must be:

Novel (new and not disclosed publicly anywhere before the filing date)

Have an inventive step (non-obvious to a person skilled in the art)

Be industrially applicable

4. Exclusions from Patentability

Discoveries, scientific theories, mathematical methods

Schemes, rules or methods for doing business, performing mental acts, or playing games

Inventions contrary to public order or morality

Certain biological and genetic materials (depending on specific regulations)

5. Filing and Examination

Patent applications must be filed with the Kuwait Patent Office.

Kuwait is not a member of the Patent Cooperation Treaty (PCT), so international patent applications via PCT are not directly applicable.

The application undergoes formal and substantive examination to verify compliance with patentability criteria.

6. Patent Term and Renewal

Patents are granted for a term of 20 years from the filing date.

Annual renewal fees are required to keep the patent in force.

7. Enforcement

Patent infringement can be enforced via civil litigation in Kuwaiti courts.

Remedies include injunctions, damages, and seizure of infringing products.

8. International Treaties

Kuwait is a member of the Paris Convention for the Protection of Industrial Property.

Kuwait is not a member of the PCT but has bilateral agreements with some countries on IP matters.
