Section 185 The Indian Contract Act, 1872

Section 185 of the Indian Contract Act, 1872 states:

"Liability of finder of goods."
When any person finds goods belonging to another and takes them into his custody, he is subject to the same responsibility as a bailee.

🔍 Explanation:

This section imposes a legal duty on a finder of lost goods similar to that of a bailee.

If a person finds goods that belong to someone else and takes possession of them,

They must take reasonable care of those goods,

And must return the goods to the rightful owner when claimed.

✅ Key Points:

The finder is considered a bailee under law.

The finder must take care of the goods with reasonable diligence.

Failure to do so can make the finder liable for any loss or damage.

The finder must try to locate and deliver the goods to the true owner.

🧑‍⚖️ Example:

Mr. A finds a lost smartphone on the street and takes it home to keep it safe. Under Section 185, Mr. A is responsible for taking reasonable care of the smartphone and must return it if the rightful owner comes forward.
