Section 320 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023

Sure! Here’s a summary of Section 320 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in English:

Section 320 – Procedure for Issuing Commissions for Examination of Witnesses

If the witness is within the jurisdiction of the BNSS:

The commission to record the witness’s evidence shall be sent to the Chief Judicial Magistrate (CJM) of the area where the witness is located.

If the witness is in India but outside the jurisdiction of BNSS:

The commission shall be sent to such court or officer as the Central Government may notify for this purpose.

If the witness is outside India:

The commission may be sent to the court or officer in the foreign country if the Central Government has arrangements or agreements with that country for recording witness evidence.

Purpose:

This section ensures that even if a witness is not physically present within the area of trial, their testimony can still be recorded efficiently through the appropriate authority, whether inside or outside India.
