Section 390 of the Companies Act, 2013

Section 390 of the Companies Act, 2013 pertains to the "Application of sections 391 to 394 to liquidators."

However, please note that Sections 391 to 394 under the Companies Act, 1956 dealt with Compromise, Arrangements, Amalgamations and Reconstruction, and Section 390 served as an enabling provision applying those sections to liquidators as well.

In the Companies Act, 2013, the corresponding provisions are covered under Sections 230 to 240, and Section 390 (as per the 2013 Act) is now a repealed/omitted or non-operative provision and does not contain substantive content.

Summary:

Section 390 in the Companies Act, 2013 does not contain active provisions as per the latest amendments and is considered inoperative.

The functional equivalent of old Section 390 (of 1956 Act) is now covered under Section 230 to 240 (Compromises, Arrangements and Amalgamations) in the 2013 Act.
