Section 5 of the Probation of Offenders Act, 1958 deals with the procedure when a person is released on probation.

Section 5: Procedure on Release on Probation

When a court releases an offender on probation of good conduct under this Act, it may require the offender to enter into a bond (with or without sureties) for their good behavior for a specified period, which cannot exceed three years.

The court can impose conditions as it thinks fit for the supervision and control of the offender during this period.

The offender will be under the supervision of a probation officer or any other person appointed by the court.

The court may also require the offender to report periodically to the probation officer or other appointed persons.

If the offender breaks the bond or the conditions of probation, the court may order the offender to be tried and sentenced for the original offence.
