LEGAL NOTICE
Under instruction of my client XYZ, HAVING ADDRESS AT ……………………, we have to instruct you as under:-
- That you were appointed as Manager Production Planning & Control (PPC) & Purchase with effect from ……………………….. with (Company Name). You were entrusted with job and responsibility assigned to you by your supervisor and senior.
- That you were initially appointed on probation for period of three month which was to be increased/ reduced depending upon your conduct.
- That during the short period of your joining, the employer noticed your wayward behaviour and you lack of interest and commitment towards the works assigned to you right from the beginning.
- That on ……………………….., you resigned during your probation period from the post without serving the employer with the mandatory one month notice in terms of the Employment Contract dated ……………... You have thus rendered yourself liable to compensate the employer with one month salary that you last drew.
- That the employer had also entrusted you with a laptop of brand HP, having the purchase value of Rs. 60,000/- (Rs Sixty Thousand Only), which you have illegally retained along with yourself and have not returned the same to the employer.
- That above act of yours amounts to criminal breach of trust within the meaning of section 406 of the Indian Penal Code, 1860, which is a cognizable and a non-bailable offence. Since you have committed this offence in capacity of an employer, the ingredients of section 408 of the India Penal code, 1860 is also squarely attracted in this case, which is again a cognizable and non-bailable offence with a punishment for imprisonment of 7 years and fine.
- We therefore, by way of this notice, call upon you to compensate the employer with (i) one month’s last drawn salary in terms of the Employment Contract dated 01.06.2022 for your failure to give one month’s mandatory notice before resignation; and (ii) handover the laptop and/or any other assets belonging to the employer within seven days from the date of receipt of this notice failing which we have instructions to approach to institute a criminal case against you before the appropriate court of law, which would be at your own cost and consequences.
