Documentation Charges Dispute Banking Consumer Case .

1. What are Documentation Charges?

Charges levied for vetting, preparing, stamping, handling loan documents, legal scrutiny, TEV [Techno-Economic Viability] study, CERSAI, etc. Legally allowed, but only under strict conditions.

2. When does it become a dispute?

A dispute becomes a Consumer Case under Consumer Protection Act, 2019 if:

a) Non-disclosure at pre-sanction stage: As per RBI Fair Practices Code for Lenders and RBI Digital Lending Guidelines 2022/2025, all fees must be disclosed in Key Fact Statement [KFS] before loan agreement. Levying charges subsequently without disclosing is held as unfair practice.

b) No consent / No service: Charging documentation charges when loan is not disbursed, or charging twice, or collecting in advance but calculating interest on full loan amount - RBI has called this unfair and directed refunds.

c) Excessive / Arbitrary: Even if RBI does not fix a ceiling, consumer fora can hold excessive penal interest / charges as unfair trade practice u/s 2(47) and unfair contract u/s 2(46) of CPA 2019.

d) Hidden in fine print: Law requires all fees, charges and terms be fully disclosed before finalization, else consumer can seek compensation.

Your right includes right to cancel/modify loan if terms changed without consent.

3. Legal Framework Used in Complaint

  1. RBI Fair Practices Code: Banks must provide copy of loan agreement + all charges breakdown. Standardised KFS mandatory with interest, fees, all costs.

4. Important Case Laws

1. Bank of India Vs M/s Brindavan Agro Industries Pvt Ltd, Supreme Court of India, 28 Feb 2020
This is the leading SC judgment on processing/documentation charges. SCDRC and NCDRC had ordered full waiver of TEV and processing charges. SC set aside those orders, holding that bank was justified in deducting processing fees and TEV study charges upfront as the consumer was aware of these charges and the bank's procedure. However, since Bank itself had agreed via email to refund Rs.9.16 lakhs from processing charges, consumer was entitled only to that amount, not full waiver.
Ratio: If disclosed in sanction letter/agreement and accepted, documentation charges are not deficiency. But if Bank offers refund, it must honour it.

2. ICICI Bank - NCDRC on loss of documents - 2022-23
NCDRC held that loss of ownership documents by bank amounts to negligence and bank must compensate, directing Rs.25 lakhs compensation over lost property documents. Often clubbed with documentation charge cases where bank charges for documents but fails to preserve them.

3. The Chief Manager Vs V.C Janardhanan - Consumer Court Kerala
Bank collected Rs.3190 as documentation charge + Rs.574 GST totaling Rs.3764. Commission observed such charges are normal in banking transactions unless complainant proves they were not part of agreement. Consumer lost because he failed to prove non-inclusion.

4. J&K Bank - District Consumer Commission Kupwara, March 2026
Held J&K Bank liable for deficiency for disbursing loan to third party without consent and charging EMIs and fees on entire amount. Principle applied to documentation charges - cannot charge for a loan not lawfully disbursed to borrower.

5. Bajaj Finance Ltd. Vs Amarjeet Singh - NCDRC
Complainant took loan of Rs.3 crore on assurance of no foreclosure charges, but foreclosure/documentation charges were levied. NCDRC held it as unfair trade practice due to misrepresentation at time of sale.

6. Consumer Action Group Vs RBI & Others
PIL under Consumer Protection Act challenging arbitrary increase in service charges for cheque collection, DD, loan processing, ledger folio charges etc. Led to RBI tightening Fair Practices Code disclosure norms in 2008.

5. How to Win a Documentation Charges Case - Checklist

For Consumer:

  1. Get Sanction Letter, KFS, Loan Agreement - highlight where documentation charges are NOT mentioned.
  2. Get Statement of Account showing debit.
