CRIME VICTIMS COMPENSATION

RULE 143-1-.01

Purpose and Authority

The rules of the Crime Victims Compensation Board are adopted pursuant to the authority granted under Georgia law to establish procedures for the administration of compensation to victims of criminal acts. These rules govern eligibility, application procedures, award determinations, and limitations on compensation.

RULE 143-1-.02

Definitions

Terms used in this chapter shall have the meanings assigned to them by statute or as defined by the Board, including but not limited to:

Victim

Claimant

Criminally injurious conduct

Dependent

Compensation

Collateral source

RULE 143-1-.03

Eligibility for Compensation

Compensation may be awarded to innocent victims of criminally injurious conduct and, in the event of death, to eligible dependents. Eligibility requirements include cooperation with law enforcement and timely reporting of the crime.

RULE 143-1-.04

Ineligible Claims

Compensation shall not be awarded when:

The victim participated in the criminal activity

The injury resulted from traffic offenses (except as allowed by law)

The claim is filed outside the statutory time limits

The victim failed to cooperate with law enforcement without good cause

RULE 143-1-.05

Application for Compensation

Applications must be submitted on forms prescribed by the Board and must include required documentation supporting the claim, including proof of expenses and verification of the criminal incident.

RULE 143-1-.06

Compensable Expenses

Compensation may be awarded for certain expenses, including:

Medical and dental care

Mental health counseling

Funeral and burial expenses

Loss of support for dependents

Crime scene cleanup (as allowed by law)

RULE 143-1-.07

Limitations on Awards

Awards are subject to statutory maximums and may be reduced by collateral sources such as insurance, restitution, or other benefits received by the claimant.

RULE 143-1-.08

Hearing and Review Procedures

Claimants may request reconsideration or a hearing for denied or reduced claims in accordance with procedures established by the Board.

RULE 143-1-.09

Confidentiality

Records and information submitted to the Board shall be treated as confidential to the extent permitted by law.

RULE 143-1-.10

Effective Date and Amendments

These rules shall become effective upon adoption and may be amended or repealed in accordance with applicable administrative procedures.
