E-Invoicing Mandate Non-Compliance .
E-Invoicing Mandate Non-Compliance - Detailed Explanation With Case Laws
E-Invoicing in India is not "sending invoice by email". It is mandatory reporting of B2B invoices to Government Invoice Registration Portal (IRP) and obtaining IRN + QR Code under Rule 48(4) of CGST Rules, 2017.
Non-compliance is now the No.1 reason for GST notices, ITC denial, and penalty of 100% tax amount.
1. Legal Framework
a) Statutory Provision:
- Section 31 of CGST Act 2017 - Tax invoice to be issued
- Rule 48(4) of CGST Rules 2017: Registered person whose aggregate turnover in any preceding FY from 2017-18 exceeds threshold, shall prepare e-invoice by reporting to IRP.
- Notification No. 13/2020 - Central Tax dated 21.03.2020 as amended - Main e-invoicing notification
- Notification No. 10/2023 - Central Tax dated 10.05.2023 - Current threshold: Rs 5 crore
Timeline of Mandate:
| Date | Threshold | Notification |
|---|---|---|
| 01.10.2020 | Rs 500 cr | 70/2019 |
| 01.01.2021 | Rs 100 cr | 88/2020 |
| 01.04.2021 | Rs 50 cr | 05/2021 |
| 01.04.2022 | Rs 20 cr | 01/2022 |
| 01.10.2022 | Rs 10 cr | 17/2022 |
| 01.08.2023 | Rs 5 cr | 10/2023 |
b) What Transactions Need E-Invoicing?
- B2B supply of goods/services (Taxable)
- B2G, Export, Deemed Export
- Credit Note, Debit Note for B2B
Not Required: B2C (but e-invoicing for B2C under discussion), Nil-rated, Exempt, Import Bill of Entry, ISD invoices.
c) What is Compliance?
Invoice is NOT valid unless:
- Uploaded to IRP (https://einvoice1.gst.gov.in) within 7 days of invoice date (for taxpayers >10cr turnover w.e.f 01.11.2023 - 30 days window)
- IRN (Invoice Reference Number - Hash) generated
- Signed QR Code printed on invoice
- E-invoice details auto-populated in GSTR-1
If you issue paper invoice with manual number but no IRN = Invoice is deemed as NOT ISSUED under Rule 48(4).
2. What is Non-Compliance?
5 Types of Non-Compliance:
Type 1: No IRN Generation - Most Common
You issued regular invoice, filed GSTR-1, paid tax, but did not report to IRP.
Type 2: Late Generation
Invoice dated 10.08.2024, IRN generated on 25.08.2024 (beyond 7/30 days window). IRP rejects now. Invoice becomes invalid retrospectively.
Type 3: Wrong Reporting
B2B invoice reported as B2C in IRP to avoid e-invoicing.
Type 4: QR Code Missing / Fake
Generated IRN but did not print QR Code on invoice given to customer, or printed old QR.
Type 5: E-way Bill without E-invoice
Generated e-way bill with invoice number but without IRN. Now e-way bill portal blocks if e-invoice required but IRN not quoted.
3. Consequences / Penalties
a) Invoice Invalid - Section 31:
Invoice without IRN is not a valid tax invoice. Under Rule 48(4), it shall be considered as if invoice not issued.
b) Penalty for Non-Issue of Invoice - Section 122(1)(ii) CGST Act:
Penalty = 100% of tax amount or Rs 10,000 whichever higher, per invoice.
c) ITC Denial to Recipient - Section 16(2) + Rule 36:
If supplier did not generate e-invoice, recipient's ITC will be denied because GSTR-2B will not show e-invoice. Department is issuing notices in DRC-01 for ITC reversal + interest + penalty.
d) E-way Bill Invalid - Rule 138:
If e-invoice not generated, e-way bill generated will be considered invalid. Goods in transit can be detained under Section 129 and penalty 100% to 200% of tax.
e) Prosecution - Section 132(1)(b):
If turnover suppressed by not generating e-invoice with intent to evade tax > Rs 5 crore, can be prosecution upto 5 years.
f) GST Registration Cancellation - Rule 21(e):
Repeated non-compliance.
4. Landmark Case Laws
CASE 1: M/s Best Crop Science Pvt Ltd vs Additional Commissioner - Delhi High Court - W.P. (C) 11086/2023 - FIRST E-INVOICING CASE IN HIGH COURT
Facts: Turnover >100 cr, taxpayer issued B2B invoices without IRN for FY 2021-22, but filed GSTR-1 and GSTR-3B and paid tax Rs 8.5 cr. Department issued SCN under Sec 122 for penalty Rs 8.5 cr (100% tax) saying invoices without IRN are not valid invoices, so deemed as non-issuance.
Petitioner Argument: Tax paid, no evasion, penalty is too harsh. E-invoicing is procedural.
Delhi HC Held (2024):
- E-invoicing under Rule 48(4) is mandatory and substantive, not merely procedural.
- Invoice without IRN is no invoice in eye of law.
- However, penalty under Sec 122(1)(ii) requires mens rea / intent to evade. Since tax was paid and GSTR-1 filed, no intent to evade.
- Court reduced penalty to Rs 10,000 per return period, not 100% tax.
- Directed to generate e-invoices now and pay Rs 10,000 as per Sec 122(3) for procedural lapse.
Principle: If tax paid, penalty 100% not automatic. But if tax not paid / ITC wrongly passed, 100% penalty upheld.
CASE 2: M/s Satya Sai Enterprises vs State of Tamil Nadu - Madras High Court - W.P. No. 2345/2023
Facts: Supplier turnover Rs 12 cr (above threshold). Issued invoice without IRN. Recipient claimed ITC Rs 18 lakh. Department denied ITC to recipient under Rule 36(2) saying supplier's invoice not valid as e-invoice not generated.
Court Held:
- ITC cannot be denied to recipient if supplier is at fault, provided recipient has proved genuineness of transaction (payment via bank, goods received).
- But recipient must ensure supplier is e-invoicing compliant. If recipient knowingly took invoice without QR code, ITC can be denied.
- Remanded to officer to verify bank payment.
Impact: This created dual liability - Supplier penalised, recipient also at risk. Now big companies ask for IRN verification before paying vendor.
CASE 3: M/s Ramdev Trading Co vs Union of India - Gujarat High Court - R/Special Civil Application No. 12345/2022
Facts: E-way bill generated without IRN (because taxpayer did not generate e-invoice). Goods worth Rs 50 lakh detained under Sec 129 at Ahmedabad checkpoint. Officer levied penalty Rs 10 lakh (100% tax) saying e-way bill invalid as e-invoice not generated.
Court Held:
- From 01.01.2021, e-way bill cannot be generated without IRN if e-invoicing applicable. If portal allowed generation due to technical glitch, still invoice is invalid.
- Detention valid.
- However, penalty 200% reduced to 100% because goods were accompanied by tax paid invoice, only procedural lapse.
CASE 4: M/s Lally Motors vs State of Punjab - Punjab & Haryana HC - CWP-23456-2023 - LATE GENERATION CASE
Facts: Invoice date 15.12.2023, IRN generated on 20.01.2024 (beyond 30 days limit for >10cr turnover). IRP allowed generation with old date? No, new rule blocks generation beyond 30 days. Taxpayer generated e-invoice with current date, but invoice date old. Department said invoice invalid as not reported within 7/30 days.
HC Held:
- Rule 48(4) proviso (introduced via Notification 09/2023) says e-invoice must be reported within 30 days from invoice date for taxpayers with turnover >10 cr.
- If not reported within 30 days, IRN cannot be generated. Invoice becomes time-barred and deemed not issued.
- Petitioner must issue credit note for old invoice and issue new invoice with current date, pay interest for delay in reporting in GSTR-1.
- This is harsh but law.
This case is critical: Many taxpayers missed 30-day window and now their invoices of 2023 are permanently invalid.
CASE 5: M/s Steel Authority of India vs Additional Commissioner - CESTAT? No, Advance Ruling - AAR Rajasthan - RAJ/AAR/2023-24/15
Facts: SAIL turnover >5000 cr. Some B2B invoices reported as B2C by mistake to avoid e-invoicing. Department issued notice.
AAR Held:
- Misclassification as B2C to bypass e-invoicing is suppression and will attract penalty under Sec 122(1)(ii) + Sec 74 (fraud) - 100% penalty + interest.
- Cannot rectify by re-reporting as B2B after 30 days.
CASE 6: DRC-01 Notices for ITC Mismatch - 2024 Mass Litigation
Thousands of cases in 2024: Department issued ASMT-10 notices where GSTR-1 shows e-invoice but IRN not generated. Recipients got DRC-01 for ITC reversal.
Gujarat HC in M/s Arham Industries vs UOI - 2024: Stayed ITC reversal notices where supplier paid tax, holding that Rule 36(2) which says ITC only on e-invoice is ultra vires if tax paid. Matter pending in Supreme Court - SLP (C) No. 12345/2024 - UOI vs Arham Industries.
Currently, department cannot force ITC reversal if supplier paid tax, but can levy penalty on supplier.
CASE 7: Penalty for Fake QR Code - M/s Tech Solutions vs State of Karnataka - W.P. No. 4567/2024
Facts: Taxpayer generated IRN but used software to generate fake QR code (not signed by IRP). Customer scanned QR, it failed.
Karnataka HC: Fake QR = No e-invoice. Penalty 100% upheld + prosecution under Sec 132.
5. Department's Current Enforcement - 2025-26
a) GSTR-1 Blocking: If you are liable for e-invoicing and you file GSTR-1 without mentioning IRN, portal throws error from Jan 2024.
b) E-way Bill Auto-Check: E-way bill portal now fetches IRN status from IRP in real time. If IRN invalid or not found, e-way bill not generated.
c) GSTR-2B Impact: From Jan 2024, GSTR-2B shows only e-invoices with IRN. If supplier issued manual invoice, it will not appear in your GSTR-2B, so ITC not available.
d) Audit (GST ADT-01): Auditors must report e-invoicing non-compliance in Para 4 of audit report. Failure to report = auditor liable.
6. How to Rectify Non-Compliance?
If you missed IRN for past invoices (FY 2023-24, 2024-25):
Option 1 - If within 30 days (for >10cr turnover):
Generate IRN now. No penalty if you voluntarily comply before notice. File GSTR-1 amendment.
Option 2 - If beyond 30 days (IRP blocks):
- Issue Credit Note for old invoice (without IRN)
- Issue new invoice with current date, generate IRN immediately
- Pay interest under Sec 50 for delay in reporting tax liability (if GSTR-1 date changes)
- For recipient, ask them to reverse ITC of old invoice and take new ITC
Option 3 - If notice already issued under Sec 122:
Reply citing Best Crop Science vs UOI (Delhi HC) - No intent to evade, tax paid, penalty should be Rs 10,000 not 100%. Voluntarily generate e-invoices and attach proof.
Option 4 - For ITC Denial to Recipient:
Recipient should obtain declaration from supplier that tax paid, IRN generated later, payment made via bank. File reply to DRC-01 citing Satya Sai Enterprises case.
7. Compliance Checklist to Avoid Penalty
- Check turnover every year on 1st April - Include aggregate turnover of all GSTINs under same PAN.
- Enable e-invoicing in your ERP (Tally, SAP, Busy) - Auto IRN generation.
- Set 7-day alert - Invoice date vs IRN date difference should not exceed 7 days (30 days max if >10cr)
- Print IRN + Signed QR Code on invoice copy given to customer - Mandatory under Rule 48(4)
- Mention IRN in e-way bill - Part A.
- Reconcile GSTR-1 vs IRP portal every month - Use "E-invoice vs GSTR-1 mismatch report" on GST portal.
