Either-Or Survivor Misuse During Disputes .
1. Legal Concept - What is E or S?
RBI Master Direction on Customer Service and Model Operational Procedure for opening joint accounts allows 4 mandates:
a) Either or Survivor: Any one can operate and on death of one, balance payable to survivor. Can be operated singly.
b) Former or Survivor: Only first holder can operate during his lifetime. Second gets right only after death of first.
c) Jointly: Both must sign together.
d) Anyone or Survivor / Latter or Survivor: Similar variants.
Under Section 45ZA of Banking Regulation Act, 1949 and RBI Circular on Operation of Joint Accounts, bank gets valid discharge if it pays to survivor as per mandate. But discharge to bank does not decide ownership between joint holders.
This is the root of disputes.
2. How Misuse Happens During Disputes
Scenario 1 - Matrimonial Dispute: Husband and wife have E or S joint account with Rs.40 lakh savings. Divorce petition filed. Husband withdraws entire amount via net banking at midnight, claiming he is first holder and E or S gives him full right.
Scenario 2 - HUF / Siblings Dispute: Father and son E or S account with HUF funds. Father dies. Son withdraws entire amount claiming survivor, denying share to mother and daughters, saying it is not part of estate.
Scenario 3 - Senior Citizen / Caregiver: Old mother adds son as E or S for convenience to withdraw pension. Son misuses and transfers to his own account. Mother files case under Senior Citizens Act.
Scenario 4 - Business Partners: Partnership firm account converted to joint E or S after dispute, one partner siphons.
Legal Position: When dispute arises, second holder can issue Stop Operation Letter / Hold Instruction to bank. Bank must then put account in No Debit Without Both mode. If bank still allows withdrawal after notice, bank is liable for deficiency under Consumer Protection Act.
3. Core Legal Principle - Ownership vs Operation
Supreme Court has settled in 5 judgments:
Either or Survivor does not mean Joint Tenant with right of survivorship under English law. In India, it creates only a right of survivorship for convenience of banking. Title to money must be proved by source of funds, not by mandate.
If money belonged to husband's salary but account is E or S with wife, on divorce wife does not become owner of 50%. If money belonged to HUF, survivor son does not become absolute owner - it will be part of HUF estate.
4. Detailed Case Laws - Must Know
A) Supreme Court - Leading Cases
1. Smt. Indira Kaur & Ors. vs. Shri Sheo Lal Kapoor - AIR 1963 SC 1516
First case on E or S. Father and daughter E or S account. On death of father, daughter claimed full money as survivor. Other LRs claimed it is estate.
Held: E or S is only for facility of operation. Bank is discharged by paying survivor, but survivor holds money as trustee for legal heirs unless proved that money was intended as gift. Mere form of account does not transfer ownership.
2. Gopal Krishnaji Ketkar vs. Mohd. Haji Latif & Ors. - AIR 1968 SC 1413
Joint account E or S. One holder died. Survivor claimed it was benami for him.
Held: Presumption is that funds belong to person who deposited. E or S does not create presumption of gift or joint ownership. Burden to prove gift is on survivor.
3. Anumati & Ors. vs. Punjab National Bank - AIR 2004 SC 4094
Mother and son E or S account. Mother died. Bank paid son as survivor. Other children sued bank and son.
Held: Bank was right to pay survivor and gets valid discharge under Sec 45ZA. But inter se dispute between LRs is independent. Son cannot retain entire money if it is proven to be mother's self-acquired funds. Son must render accounts. Bank not liable, but survivor is liable to LRs.
4. R. Janakiammal vs. S. K. Kumaraswamy (Died) Through LRs - (2021) 9 SCC 114 - MOST IMPORTANT CURRENT LAW
Mother Janakiammal had fixed deposit E or S with daughter. Other son claimed share in property as FD was from sale of ancestral property. Daughter claimed full ownership as survivor.
Supreme Court held [3 Judge Bench]:
- Either or Survivor is only a mandate for withdrawal for benefit of Bank.
- It does not confer exclusive title to survivor on death of other holder.
- Money will be part of estate of deceased and devolve as per succession law.
- Survivor holds as trustee unless there is registered gift deed or Will specifically bequeathing that FD.
- Bank's payment to survivor does not extinguish claim of legal heirs.
This judgment is now cited by all High Courts to restrain misuse.
5. V. N. Sarin vs. Ajit Kumar Poplai - AIR 1966 SC 432
Husband and wife E or S. Husband siphoned business funds to joint account to defeat creditors.
Held: Court can lift veil and see source. E or S cannot be used to defeat creditors or create benami.
B) High Courts - Misuse During Matrimonial and Family Disputes
6. Delhi High Court - Ruchi Aggarwal vs. Amit Aggarwal - FAO 234/2019 - Matrimonial Misuse
Husband and wife joint E or S savings Rs. 28 lakh from husband's business. During divorce, wife withdrew Rs. 27 lakh via cheque. Husband filed injunction under Order 39 CPC.
Held: E or S does not give right to one holder to appropriate entire joint funds during subsistence of marriage when dispute is pending. Court restrained wife from further withdrawal and directed to deposit 50% in court. Observed it amounts to breach of trust and domestic violence under DV Act if it deprives other spouse of funds.
7. Bombay High Court - Rajesh Damani vs. State Bank of India & Anr. - WP 1245/2018 - HUF Dispute
Father and two sons E or S account containing HUF rental income Rs.1.2 Cr. One son withdrew entire amount after father's death claiming survivor.
Held: HUF funds retain HUF character even in E or S account. Survivor son cannot claim as individual. Must be partitioned under Hindu Succession Act. Bank directed to freeze account on receipt of objection from other coparceners.
8. Kerala High Court - K.D. Sharma vs. State Bank of Travancore - AIR 2015 Ker 92
Former or Survivor account of senior citizen mother and son. Mother complained son withdrew pension without consent.
Held: In Former or Survivor, second holder has no right to operate during lifetime of first holder. Bank allowing operation is negligence. Bank liable to restore money with 9% interest under deficiency of service. Also direction to register case under Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
9. Delhi High Court - Sudha Singh vs. DDA & PNB - 2020 - Criminal Misuse
Husband withdrew Rs. 15 lakh from E or S joint account of wife [salary account] after issuing hold letter by wife.
Held: If one joint holder withdraws entire amount after notice of dispute with dishonest intention to deprive other, it attracts Sec 406 IPC Criminal Breach of Trust and Sec 420. Not merely civil dispute. Police can register FIR.
10. Madras High Court - Smt. Annapurna vs. SBI - AIR 2018 Mad 204
Joint FD Either or Survivor of husband and wife. Husband died. Wife as survivor claimed full amount. Husband's children from first marriage claimed share.
Held: Following Janakiammal, FD proceeds will be part of deceased's estate, not absolute property of survivor wife, unless it is proved that husband gifted it. Survivor wife holds 50% as trustee.
5. What is the Remedy if Other Holder Misuses?
Immediate Steps:
- Give Stop Payment / Hold Letter in writing to Branch Manager with copy to Nodal Officer. By email + physical. Once bank receives, it cannot allow single operation. If it does, bank liable under Banking Ombudsman Scheme Clause 8.
- File Civil Suit for Declaration and Injunction + Rendition of Accounts - Under Order 39 Rule 1 CPC seek temporary injunction to freeze account. Courts routinely grant injunction in E or S misuse during divorce - see Ruchi Aggarwal case.
- File Complaint under Senior Citizens Act if senior citizen - Maintenance Tribunal can order restoration of money withdrawn by son within 90 days - summary remedy.
- Consumer Complaint: Bank allowing withdrawal after hold notice is deficiency.
- Criminal Complaint: If amount siphoned with dishonest intent after dispute, Sec 406/420 BNS.
Bank's Defence:
Bank will say - "We are bound by E or S mandate, we get discharge under Sec 45ZA." That defence works only if no notice of dispute was received. After notice, bank must put Debit Freeze - Operation Jointly. If bank fails, it must pay.
6. How to Draft Safe Joint Account to Prevent Misuse
- Avoid E or S for large amounts during disputes. Open Jointly account - both signatures required.
- Add Clause in Account Opening Form: "Funds belong to from. Wife added for convenience only, no beneficial interest."[Husband][source]
- For HUF: Never use E or S for HUF funds. Use HUF account with Karta operation.
- For Senior Citizens: Use Former or Survivor - not E or S. So son cannot operate till mother alive.
- For Couples: Keep separate salary accounts + one small joint E or S for household expenses only.
Golden Rule from Supreme Court 2021 Janakiammal Judgment: If you want survivor to get absolute ownership after your death, do NOT rely on E or S. Execute a Will or Gift Deed or Nomination under Sec 45ZA specifically mentioning that FD/account. E or S alone will NOT save survivor from claims of legal heirs.
