Kansas Constitution – Article Fifteen: Miscellaneous

Article 15 of the Kansas Constitution contains a variety of provisions that do not fall under the more structured categories of other articles. These “miscellaneous” sections address important general matters of public policy and governance. Below is a summary of its key sections:

Section 1 – Homestead Exemption

A homestead (residence) of not more than 160 acres of land, and not exceeding a certain value (as defined by law), is exempt from forced sale under any process of law.

Applies to the head of a family or a person age 60 or older.

This exemption does not apply to debts incurred for:

Purchase of the property

Taxes

Mechanic’s liens

Mortgage foreclosures

Section 2 – Intoxicating Liquors

The legislature may regulate or prohibit the manufacture and sale of intoxicating liquors.

The section has been amended over time, especially after Prohibition was repealed nationally.

Section 3 – Lotteries

Originally prohibited all lotteries, but later amended to allow certain types, including:

State-operated lotteries

Bingo and charitable gaming

Pari-mutuel wagering (e.g., on horse or dog racing)

Section 4 – Bribery and Corruption

Provides for the disqualification from office of any person convicted of bribery, perjury, or other infamous crimes.

Section 5 – Dueling

Anyone involved in a duel (either participating or aiding) is ineligible to hold public office.

Section 6 – Oath of Office

Requires all civil officers to swear an oath to uphold the Constitution of the United States and the Constitution of Kansas.

Section 7 – Removal of Public Officers

The legislature may provide for the removal of officials not otherwise covered in the Constitution, through methods like recall, impeachment, or legislative action.

Section 8 – Compensation of Officers

Prohibits increasing or decreasing the salary of a public officer during their term unless otherwise provided by law.

Section 9 – Felons in Office

No person convicted of a felony may hold public office unless their civil rights have been restored.

Section 10 – Disability Rights

No person shall be denied the equal protection of the laws because of physical disability.

The state must encourage full participation in society for persons with disabilities.
