Utah Constitution Article 17 Water Rights
Here is the full text of Article XVII – Water Rights from the Utah Constitution:
Article XVII — Water Rights
Section 1. [Existing rights preserved.]
All existing rights to the use of any of the waters in this State for any useful or beneficial purpose are hereby recognized and confirmed.
Section 2. [Water is property of State.]
All waters in this State, whether above or under the ground, are hereby declared to be the property of the public, subject to all existing rights to the use thereof.
Section 3. [Appropriation.]
The right to the use of water for any useful purpose shall be acquired as provided by law, and all such rights shall be subject to regulation and control as provided by law.
