Utah Constitution – Article XXIII: Amendment and Revision

Purpose:
This article outlines the process for amending or revising the Utah Constitution.

Section 1 – Proposal of Amendments by Legislature

The Utah Legislature may propose constitutional amendments.

To do so, two-thirds of all members of each house (Senate and House of Representatives) must vote in favor.

Once passed by the Legislature, the amendment is submitted to the voters at a general election.

If a majority of voters approve, the amendment becomes part of the Constitution.

Section 2 – Revision by Constitutional Convention

A constitutional convention to revise the Constitution can be called in two ways:

By a two-thirds vote of both houses of the Legislature, followed by a majority vote of the people.

Or, the people may vote directly to call a convention if the question is placed on the ballot by law.

Any revised constitution or amendments proposed by the convention must be approved by a majority of voters before taking effect.

Section 3 – Publication and Publicity

Proposed amendments or revisions must be published in at least one newspaper per county, or through other means as prescribed by law, at least 12 weeks before the election.

Section 4 – Effective Date

Approved amendments take effect on the first day of January following the election unless a different date is specified.
