1. Valuation of Used Rolling Stock and Equipment (W. Va. Code R. §220-1-2)

Acquisition Threshold: The Division may acquire rolling stock and equipment valued at $1,000,000 or less without adhering to the provisions of W. Va. Code §5A-3, et seq.

Valuation Procedure:

Two qualified individuals with expertise in the railroad industry inspect the proposed equipment.

The Commissioner verifies the current market value through consultations with railroad equipment dealers, brokers, or other railroads.

Documentation, including signed price quotes and statements of value, is maintained on file at the Division's office.

Documentation: The Division must maintain a signed price quote from the vendor, the Commissioner's justification, and the statements of value from independent dealers, brokers, or railroads on file at the office of the Division of Multimodal Transportation Facilities.

2. Matching Grant Process (W. Va. Code R. §220-2-5)

Funding Source: Matching Grant Funds are derived from the aviation fuel tax deposited in State Fund 8275, as well as other available sources as directed by the State Legislature.

Eligible Projects: Maintenance projects related to the rehabilitation and improvement of existing airport infrastructure, including but not limited to:

Obstruction removal/mitigation and reporting.

Runway and taxiway markings.

Pavement maintenance and rehabilitation.

Lighting and signage improvements.

Terminal building enhancements.

Grant Limit: The program may pay up to one-half (1/2) of the non-federal share of all FAA-funded projects at airports in the state.

3. Direct Grant Process (W. Va. Code R. §220-2-4)

Funding Source: Grants issued under this program may generally be used by airports for any reasonable and necessary business purpose, excluding funds derived from the aviation fuel tax or other sources received by the Division.

Eligibility: Airports, Aircraft Rescue and Firefighting (ARFF) services, and Commercial Air Carriers (CAP) may apply for an award of the available funds administered under this section.

Funding Allocation: Each airport will receive a pro-rata share of the general revenue funds appropriated to the Division, subject to approval by the Division of Multimodal Transportation Facilities.
