CrPC Section 297

Section 297 of the Criminal Procedure Code (CrPC), 1973 (India):

Section 297 – Power to order production of document or other thing

What does it say?

When an accused is charged with an offense that involves the use, possession, or custody of any document or thing, the Magistrate or Court can order the production of that document or thing for inspection or evidence.

This applies especially if the document or thing is necessary for the inquiry or trial.

Purpose:

To ensure that all relevant evidence—like documents, weapons, or other material objects—can be produced and examined in court.

Helps in the fair and thorough investigation and trial of the case.

Example:

If someone is accused of forging a document, the court can order the original document to be produced.

If the offense involves a weapon, the court can order the weapon to be brought to court for inspection.
