IPC Section 173
IPC Section 173: Report of the police officer on completion of investigation
Text of Section 173:
"Every investigation under this chapter shall be completed without unnecessary delay, and the officer in charge of the police station shall, as soon as investigation is completed, forward to the Magistrate —
(a) a report in writing, setting forth the facts ascertained in the investigation and stating whether or not the accused has committed the offense, and
(b) the evidence, including statements recorded under section 161 and documents seized during the investigation."
🔍 Key Points:
This section deals with the duties of the police after completing an investigation.
After investigation, the police must send a written report (commonly called the charge sheet) to the Magistrate.
The report should include:
Facts found during investigation,
Whether the accused appears to have committed the offense,
Evidence collected (witness statements, documents, etc.).
Investigation must be done without unnecessary delay.
⚖️ Importance:
It ensures timely submission of investigation results.
Forms the basis for the Magistrate to decide whether to proceed with the trial.
Failure to comply can be challenged legally by the accused.
🧑⚖️ Example:
After investigating a theft case, the police submit a report to the Magistrate describing the evidence and the accused’s involvement. This is done under Section 173.
